    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's hearings on 12 August 2009 and 19 August 2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0901016 – Planning and Building Department, Tariffs 2009

      The Planning and Building Department reports on the harmonisation of the department's fee schedules. A proposal from the Planning and Building Department was presented for a maximum fee of kr. 15,600 for lease assessments, linked to the construction index.

      The Planning and Building Council approves the proposal from the Planning and Building Department.;

    • 0906128 – Lónsbraut 56, amendment to building permit

      Björn Sigurðsson applies on 12.06.09 to amend previously approved drawings. Gables to be cast to full height in accordance with drawings by Jón Hrafn Hlöðversson, dated. 11.06.09. New drawings submitted 09.07.09. The application was considered at a service meeting of the Planning and Building Officer on 19.08.2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee is of the opinion that it is not possible to grant the request at this time, as there is no drainage in the area. The Planning and Building Committee instructs the Planning Department to carry out an assessment of the area's water and sewerage issues and to make a recommendation on the necessary actions.;

    • 0906051 – 38 Suðurgata, building permit

      On 5 June 2009, Davíð A. Stefánsson applied for permission to build an extension to a house, in accordance with drawings by Kári Eiríksson dated 9 May 2009. A report from the Hafnarfjörður Folk Museum dated 18 June 2009 and from the House Preservation Committee dated 16.6.2009 are on file. The application has been subject to local consultation, and one objection was received. The opinion of the Fire and Rescue Service has been sought; they consider the distance of the external wall to be acceptable and that its material meets the requirements for fire protection. The application was considered at the processing meeting of the Planning and Building Officer on 19 August 2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee has no objection to the application, subject to compliance with fire safety requirements, and delegates authority for its final determination to the Planning and Building Officer.;

    • 0903173 – Hringbraut 30, building permit

      The application from Gudmundur Ýmir Bragason and Guðrún Hallgrímsdóttir of 19/03/09 to demolish a carport, build a new garage, and extend the flats on the first and second floors, in accordance with drawings by Jón M. Halldórsson, dated 17.03.09. The application was subject to local consultation. Comments were received. At its meeting on 12.05.2009, the Planning and Building Committee instructed the Planning and Building Department to prepare a summary of the comments received. New drawings were received on 4 June. At its meeting on 9 June 2009, the Planning and Building Committee requested updated shadow drawings and instructed the department to present them to the landowners who had made comments during the local consultation, 16 and 18 Holtsgata. Previously submitted letter from residents of 18 Holtsgata dated 23.07.2009 and email from residents of 16 Holtsgata dated 23.07.2009. Previously submitted new drawings dated. 10.08.2009. The Planning and Building Department has previously reported on a meeting with stakeholders on 30.07.2009. The comments received have been addressed insofar as they relate to the interests of the neighbours. Postponed at the last meeting.

      The Planning and Building Committee approves the application in principle and delegates its final determination to the Planning and Building Officer.;

    • SB060701 – Strandgata 1, Library Plot

      To discuss the continuation of work on the detailed planning of the library site, Strandgata 1, in accordance with the award-winning proposal in the competition for the library's expansion.

    • 0807220 – Suðurgata - Hamarsbraut, detailed plan

      To reconsider the proposal from the Planning and Building Department for a preliminary outline plan for a site bounded by cliffs north of the houses north of Hellubraut/Hamarbraut, Suðurgata, Mýrarhóll and Strandgata, dated 17.03.2009. Previously submitted archaeological survey by the Hafnarfjörður Folk Museum for the area, dated 2009 and the opinion of the Buildings Preservation Committee regarding Hellubraut 7, dated 05.05.2009. Minutes and responses to comments from the preliminary public consultation meeting of 25.05.2009 were presented.

    • 0811062 – Hólabraut 15, unauthorised development

      The letter from the Homeowners' Association dated 04.11.08 regarding unauthorised works by Jón Karl Grétarsson on the first floor of the house was taken up again. The repeated objections of the planning and building officer have not been addressed, which decided at its meeting on 11.12.2008 that if the comments were not addressed or the alterations removed within one month, it would recommend to the Planning and Building Board that a fine be imposed in accordance with Chapter VI of the Planning and Building Act. The Planning and Building Officer referred the matter to the Planning and Building Committee on 01/07/2009, which recorded the following on 07/07/2009: The Planning and Building Committee reiterates that the owners must apply for a permit for the said works, which will be processed in accordance with the Planning and Building Act. If such an application is not received within four weeks, or the alterations are not removed, the Planning and Building Committee will recommend to the Town Council that a fine be imposed in accordance with Chapter VI of the Planning and Building Act. A letter from Gudbjörg Matthíasdóttir, solicitor for the Homeowners' Association, dated 13.07.2009, was presented, stating that consent from the other owners in the building is not available.

      As the development is a breach of the Planning and Building Act and the Act on Multiple Ownership Properties, the Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves the imposition of a daily fine of kr. 50,000 on the owner of the first floor of the building, from 1 October, should the illegal works not have been removed by that date.“;

    • 0902154 – Lyngbarð 5 and 7, Móabarð 29, plot boundaries

      Valgerður Kristjánsdóttir, Lyngbarði 5 gerir f.h. íbúa að Lyngbarði 5 og 7 athugasemd við að eigandi Móabarðs 29 hafi tekið sér hluta af lóðum þeirra og girt af. Mælingamaður Hafnarfjarðarbæjar hefur mælt lóðamörkin. Vísbendingar eru um fyrirhugaðar framkvæmdir á lóð Lyngbarðs 5. Skipulags- og byggingarfulltrúi gerði 11.02.2009 eiganda Móabarðs 29 skylt að færa girðinguna á réttan stað í samræmi við mælingu mælingamanns Hafnarfjarðarbæjar. Yrði ekki úr bætt innan 4 vikna mun skipulags- og byggingarfulltrúi vísa málinu til skipulags- og byggingarráðs með tillögu um dagssektir í samræmi við gr. 210.1 í byggingarreglugerð. Lagt fram bréf Önnu Rósu Traustadóttur og Gylfa Sigurðssonar eigenda Móabarðs 29 dags. 15.03.2009 ásamt lóðarleigusamningum fyrir umrædd hús. Skipulags- og byggingarráð óskaði 07.04.2009 eftir upplýsingum frá eigendum Lyngbarðs 5 og 7 um hvaða framkvæmdir eru fyrirhugaðar á lóðunum, og hvernig þau hyggist ganga frá lóðarmörkum. Vísað er til kafla 3 í byggingarreglugerð. Lagt fram bréf Valgerðar Kristjánsdóttur Móabarði 5 og Brynju Baldursdóttur Móabarði 7 dags. 04.05.2009 varðandi frágang á lóðamörkunum. Lagt fram ítrekunarbréf sömu aðila dags. 04.05.2009. Skipulags- og byggingarráð fól skipulags- og byggingarsviði að vinna áfram að málinu. Skipulags- og byggingarfulltrúi vísaði 10.06.2009 eftirfarandi niðurstöðu til staðfestingar skipulags- og byggingarráðs:%0D“Lóðamörk skulu vera samkvæmt lóðasamningum svo sem sýnt er á lóðablaði útgefnu af Hafnarfjarðarbæ 05.2008. Núverandi girðing milli umræddra lóða við Lyngbarð og lóðarinnar við Móabarð skal fjarlægð, og frágangur á lóðum og lóðamörkum skal unninn samkvæmt leiðbeiningum landslagsarkitekts skipulags- og byggingarsviðs í samræmi við kafla 3 í byggingarreglugerð.“ Frestað á fundi 230. Lóða- og hæðablað hefur verið sent málsaðilum.%0D

      The plot boundaries shall be in accordance with the plot agreements, as shown on the plot plan issued by the City of Hafnarfjörður in May 2008. The existing fence between the plots in question at Lyngbarð and the plot at Móabarð shall be removed, and the finishing of the plots and plot boundaries shall be carried out in accordance with the instructions of the landscape architect of the Planning and Building Department, in compliance with Chapter 3 of the Building Regulations.<SPAN style=“FONT-SIZE: 10pt; FONT-FAMILY: Verdana; mso-bidi-font-family: Arial“

      A review of the status of the work on the framework plan and a discussion of its further progress. Minutes from the working meetings of 07.05.2009, 19.05.2009, 04.06.2009, 25.06.2009 and 13.08.2009 were presented.

    • 0711020 – Upland area of Hafnarfjörður, outline plan

      The proposal from Landslags ehf for a framework plan for the hinterland of Hafnarfjörður, dated 14 February 2008, was reconsidered. Previously, a proposal for the introduction and notes from the Planning and Building Department, from meetings with interest groups on 11 and 20 November 2008, had been presented. Drafts of the framework plan were presented at a meeting of the Planning and Building Committee on 24th March 2009. At its meeting on 29th June 2009, the Planning and Building Committee referred the matter for presentation to the Environment Committee/Local Agenda 21, the Executive Committee, Family Council and the Town Council.

    • 0801336 – North bank, surface dressing

      The proposal from Landslags ehf dated 21 August 2009 for a connection between Strandstígs and Linnetsstíg was reconsidered. Postponed at the previous meeting.

      The Planning and Building Committee approves the proposal for its part. Approved by 4 votes, Rósa Guðbjartsdóttir abstains.;

    • 0907051 – Steinhella 5, illegal occupation

      Bréf barst frá Slökkviliði Höfuðborgarsvæðisins varðandi ólöglega búsetu. Skipulags- og byggingarfulltrúi gerði 15.07.2009 eigendum skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki yrði málinu vísað til skipulags- og byggingarráðs með tillögu um viðeigandi aðgerðir skv. skipulags- og byggingarlögum. Svar barst ekki. Skipulags- og byggingarráð gerði 11.08.2009 eigendum skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki yrði málinu vísað til bæjarstjórnar með tillögu um dagsektir skv. 57. grein skipulags- og byggingarlaga nr. 73/1997. Lagður fram tölvupóstur frá Sigríði Kristinsdóttur f.h. Ljósleiða ehf dags. 11.08.2009, ar sem fram kemur að búsetan sé aðeins tímabundin.%0D%0D

      The Planning and Building Committee postpones the matter and instructs the Planning and Building Department to monitor its progress.;

    • SB060361A – North Bank 7-9

      The status of the works at 7–9 Nordurbakki was discussed. A building permit was approved on 14 June 2006, with amendments approved on 28 November 2007. According to the lease agreement, the superstructure of the car park building and the ground floor slab were to be completed by 1 September 2008, and the building was to be fully completed by 1 October 2009. Construction work is still in its early stages, with only the ground slab and one wall of the car park building having been poured. The lease agreement further states that „If the lessee has commenced work on the plot, but the work does not comply with the aforementioned construction deadlines, the municipal authorities are entitled to apply the provisions of Articles 45 and 57 of the Planning and Building Act No. 97/1997, as amended, against the plot holder's defaults.“ The Director explains this during discussions with the plot holder. The matter was discussed at the planning and building officer's meeting on 19 August 2009, which referred it to the planning and building committee. A letter from Gunnar Valur Gíslason, dated 24 August 2009, on behalf of Eykt, was presented.

    • 0906198 – Holtsgata 12, load-bearing wall

      Jónína G Hjaltadóttir biður með bréfi dags 22.6.2008 um lausn þ.e. að eigandi neðri hæðar setji upp burðarsúlu í stað burðarveggjar er hann reif í heimildarleysi. Skipulags- og byggingarfulltrúi bendti 24.06.2009 á að breytingin er brot á skipulags- og byggingarlögum, grein 43.1 og gerði eiganda neðri hæðar skylt að skila inn byggingarleyfisteikningum og burðarteikningum innan fjögurra vikna frá dagsetningu fundarins 24.06.2009. Yrði ekki brugðist við því mundi skipulags- og byggingarfulltrúi vísa málinu til skipulags- og byggingarráðs með tillögu um dagsektir í samræmi við grein 57,1 í skipulags- og byggingarlögum nr. 73/1997. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 12.08.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:“Skipulags- og byggingarráð gerir eiganda skylt að skila inn byggingarleyfisteikningum og burðarteikningum innan fjögurra vikna. Verði ekki brugðist við því mun skipulags- og byggingarráð vísa málinu til bæjarstjórnar með tillögu um dagsektir í samræmi við grein 57.1 í skipulags- og byggingarlögum nr. 73/1997.“%0D

      The Planning and Building Committee requires the owner of the lower floor to submit the building permit drawings and structural drawings within four weeks. Failure to do so will result in the Planning and Building Committee referring the matter to the Town Council with a proposal for a daily fine in accordance with section 57.1 of the Planning and Building Act No. 73/1997.;

    • 0806025 – Stekkjarkinn 5, work on the uninsulated loft.

      An enquiry has been received as to whether the work on the internal fit-out of an uninsulated loft is in accordance with the issued building permit. Clarifications were repeatedly requested from the property owner, but no response was received. An inspection by the surveyor has revealed that work has been carried out without the required permit. On 17 February 2009, the Planning and Building Officer referred to section 43(1) of the Planning and Building Act and required the owner to either remove the works carried out without the required permit or, alternatively, apply for a permit for them within four weeks. Should the request not be complied with, the Planning and Building Officer would recommend to the Planning and Building Committee that a fine be imposed in accordance with Article 57, paragraph 1 of the Planning and Building Act No. 73/1997. The matter was considered at a case-handling meeting of the planning and building officer on 25 March 2008, who referred it to the planning and building committee with the following recommendation: „The Planning and Building Committee directs the property owner to either remove the works that have been carried out without a permit, or apply for a permit for them, otherwise within four weeks. If this is not complied with, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“ The Planning and Building Committee deferred the matter on 07.04.2009 as a building permit application had been received. The drawings were severely lacking, and therefore sufficient documentation has not yet been received. The matter was considered at a meeting of the planning and building officer on 12 August 2008, who referred it to the planning and building committee with a renewed recommendation for a daily fine.

      The Planning and Building Committee requires the property owner to remove the works carried out without a permit, or alternatively to submit a satisfactory application for a permit for them in accordance with section 12.2 of the Building Regulations within four weeks. Failure to do so will result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed, in accordance with Section 57 of the Planning and Building Act No. 73/1997.;
