    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's disposal meetings of 04.11.2009 and 11.11.2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0910620 – Skúlaskeið 5, extension

      On 05.10.2008, Bjarni Hrafnkelsson applied for permission to build an extension to a detached house, in accordance with drawings by VHÁ dated September 2009. The application was discussed at a meeting of the Planning and Building Officer on 07/10/2009, who referred it to the Planning and Building Committee. The submitted plans show the layout of the extension as if it were a separate flat. On 20.10.2009, the Planning and Building Committee requested further information regarding the submitted drawings. A previously submitted email from the owner, dated 02.11.2009, was provided. New drawings were received on 10.11.2009. The application was considered at a disposal meeting of the planning and building officer on 11 November 2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee approves the application in principle and delegates final approval to the Planning and Building Officer.;

    • 0911150 – Austurgata 22, enquiry

      Mát ehf submitted an enquiry on 05.11.2009, requesting to build a new house at Austurgata 22, in accordance with drawings by Kári Eiríksson dated 10.07.2007. The application was considered at the processing meeting of the Planning and Building Officer on 11 November 2009, who referred it to the Planning and Building Committee.

    • 0903168 – Reykjavíkurvegur 50, Krónan, site maintenance

      The matter of Smáragarður, on behalf of Krónan, Reykjavíkvegur 50, is reconsidered, as the Hafnarfjörður Town Council has imposed daily fines on the company from 1 September last for the condition of the site. A letter from Benedikt Ingi Tómasson, on behalf of Krónan, was presented, setting out proposals for the management of the containers and objecting to the daily fines, on the grounds that containers were shown on the plans for the Nóatún store in 2001 and the deadline for objections was too short. The letter states that the City of Hafnarfjörður's requirements are unclear and that it is not specified what is being requested. The matter was discussed at a meeting of the Planning and Building Officer on 16 September 2009. The Planning and Building Officer does not accept the explanations regarding deadlines, etc., as set out in the letter. Letters have been repeatedly sent to Krónan and the holding company Smáragarður since 18 June, in which the Planning and Building Officer requires the developer to make the containers presentable, so as not to cause an eyesore or inconvenience to neighbours, subject to a fine in accordance with the regulations. Article 57 of the Planning and Building Act No. 73/1997. To improve the appearance of the containers, they would need to be clad in some way, whatever their location. Furthermore, it is noted that an application for a building permit for alterations to the retail space was submitted when Krónan took over the premises from Nóatún, but this permit has not come into effect as it was conditional upon the submission of a register, which has still not been received. Therefore, there is no valid building permit, and the reference to one is not relevant. For his part, the Planning and Building Officer can agree to the proposed finish as shown in the letter from Smáragarður, but referred the matter to the Planning and Building Committee. A report from the Operations Department was presented. The matter was discussed at the planning and building officer's disposal meeting on 04.11.2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee endorses the Operations Department's recommendation that the containers be moved further into the car park row. The Committee emphasises that the containers should be tidily finished, and instructs the Planning and Building Department to advise the designer accordingly.

  • 09103144 – Mobile sausage van

    Wilhelm Albrecht is requesting a site for a sausage van in the centre of Hafnarfjörður, in accordance with the application dated 27.10.2009. The application was considered at the processing meeting of the Planning and Building Officer on 28/10/2009, which referred it to the Planning and Building Committee. Postponed at the last meeting.

    The Planning and Building Committee instructs the Planning and Building Department to discuss the application with the applicant.;

  • 0807220 – Suðurgata - Hamarsbraut, detailed plan

    To reconsider the proposal from the Planning and Building Department dated 18.09.2009 for a detailed plan for an area bounded by cliffs north of the houses north of Hellubraut/Hamarbraut, Suðurgata, Mýrarhlið and Strandgata. Previously submitted: the 2009 archaeological survey of the area by the Hafnarfjörður Folk Museum and the report of the Buildings Preservation Board regarding Hellubraut 7, dated 05.05.2009. Previously submitted were the minutes and responses to comments from the preliminary presentation meeting of 25 May 2009. Previously submitted were the minutes of the Planning and Building Department regarding area conservation. A new report and plan dated 30 September were previously submitted. Data dated 10 January 2009 and from the Planning and Building Department dated 8 October 2009 were previously submitted. The Director previously reported on discussions with the owner of Hellubraut 9 regarding the plot boundaries. The Director reports on discussions with the plot holder of Hellubraut 5, who is also the owner of Hellubraut 7, regarding the plot boundaries.

    Thorgerd Elísa Mortensen puts forward the question of the day. 30.10.2009 regarding the planned extension and renovation of a holiday home on their plot at Kaldárselsveg. The matter was discussed at the planning and building officer's meeting on 04.11.2009, which referred it to the planning and building committee.

  • 0903036 – Master Plan of Hafnarfjörður, amendment Sléttuhlíð

    The proposal from the Planning and Building Department dated 04.03.2009 for an amendment to the Hafnarfjörður 2005–2025 Master Plan, concerning an increase in the Sléttuhlíð settlement area, is reconsidered. Text amendment. The planning proposal was advertised on 24 August 2009 in accordance with Article 18 of the Planning and Building Act No. 73/1997, and the consultation period closed on 9 October 2009. Comments were received. A revised summary from the Planning and Building Department, dated 17 November 2009, of the comments received and a proposal for responses to them was presented.

  • 09102099 – Land and Tenancy Act, review

    A letter from the Ministry of Fisheries and Agriculture, dated 08.10.2009, was presented, announcing a working group for the review of the Land and Tenure Act. Comments and viewpoints that may be of use to the group are requested by 10 November 2009. A report from the Planning and Building Department, dated 9 November 2009, and the Environment Committee/Agenda 21's decision on it were presented.

    The Planning and Building Committee endorses the decision of the Environment Committee/Agenda 21 and the opinion of the Planning and Building Department.;

  • 0805264 – Skógarás H/7, comment

    The landowner's objection to the permit granted to raise the house at Skógarási E/6 is reconsidered. A survey by the Planning and Building Department of decisions in Ásland, dated 27.06.2008, was previously presented. The Planning and Building Committee instructed the Planning and Building Department to investigate possible measures to rectify the matter in accordance with the Planning and Building Act and regulations. Previously submitted was the letter from Björn R. Ingólfsson and Sigríður B. Guðmundsdóttir, Skógarási 7, dated 07.01.09. On 14.01.2009, the planning and building officer reiterated the request for clarification from the property owners. Previously submitted letter from Lúther Sigurðsson and Ingibjörg Ragnarsdóttir, dated 20.12.2007. An updated summary from the department head, dated 28.04.2009, was presented, along with cross-sections showing the building's elevations. The Planning and Building Committee required the owners, on 12 May 2009, to bring the house into compliance with the approved drawings. A complaint from residents of the street, dated 2 November 2009, has been received. The matter was discussed at the planning and building officer's meeting on 11 November 2009, which referred it to the Planning and Building Committee.

    The Planning and Building Committee instructs the Planning and Building Department to continue to work on the matter and to present it to the next meeting of the Committee.;

  • 0909237 – Citizens' Assembly 2009

    The proposal from the Environment Committee/SD 21, from the meeting of 30 September, regarding the preparation of a citizens' assembly was taken up again. The Environment Committee/SD 21 requested that the Planning and Building Council begin preparations for a citizens' assembly, focusing on the framework plan for the upland area, the development plan for the town centre, and the harbour authority's proposals for a new harbour west of Straumsvík. On 6 October 2009, the Planning and Building Committee proposed that a working group be established, comprising four representatives from the Committee and the Council, in addition to the existing official working group. Rósa Guðbjartsdóttir then requested that plans for the implementation and the associated costs of the citizens' assembly be presented at the next meeting. At the last meeting, the following were appointed to the working group: Gisli Valdimarsson, chair, Guðfinna Guðmundsdóttir and Guðrún Ágústa Guðmundsdóttir. The Independence Party deferred their nomination. A previously submitted email from Steinunn Þorsteinsdóttir regarding the cost and implementation of the assembly was presented. Steinunn Þorsteinsdóttir and Anna Sigurborg Ólafsdóttir attended the last meeting and discussed ideas for the implementation and cost of such a citizens' assembly. Their notes regarding the organisation and cost of the assembly were presented. Steinunn Þorsteinsdóttir and Anna Sigurborg Ólafsdóttir once again outlined their ideas for the organisation and cost of such a citizens' assembly.

    Rósa Guðbjartsdóttir a representative of the Independence Party proposes that the citizens„ assembly be postponed for the time being and therefore does not nominate a representative to the working group and submits the following statement:

    In light of the City of Hafnarfjörður's tight financial situation, the undersigned does not consider it a priority to hold a three-hour citizens“ forum on planning matters which will discuss the framework plan for the uplands and Krýsuvík, the development plan for the town centre and the harbour board's proposals for a new harbour west of Straumsvík. It is clear that major cuts are on the horizon for the municipality, and therefore the local authorities must select the most urgent projects or those that will benefit the greatest number of people in the coming months or quarters. The estimated cost of the Citizens“ Assembly is between 2 and 3 million króna, and I believe that the Citizens“ Assembly should be postponed for the time being and that the funds should be used for more pressing projects.

    Gísli Ó. Valdimarsson and Trausti Baldursson, representatives of the Social Democratic Alliance, submit the following statement:

    In the draft agenda for the citizens' forum, emphasis is placed on the town centre—planning, land use and the environment of the town centre, Hafnarfjörður Harbour - a future harbour west of Straumsvík, the Upland area and Krýsuvík - master plan, footpaths and recreational opportunities. The above includes discussions on the environment and recreation, as well as employment matters. These matters concern all residents of the town, and it is important to discuss them in cooperation with the town's inhabitants.

    Borist hafa upplýsingar um ólöglega búsetu í húsinu. Einnig að húsið sé enn skráð á byggingarstigi 1 og að lögboðnar úttektir hafi ekki farið fram, þar á meðal fokheldisúttekt. Skipulags- og byggingarfulltrúi gerði 20.05.2009 eigendum skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki yrði málinu vísað til skipulags- og byggingarráðs með tillögu um viðeigandi aðgerðir skv. skipulags- og byggingarlögum. Svar barst ekki. Skipulags- og byggingarfulltrúi vísaði 10.06.2009 málinu til skipulags- og byggingarráðs. Skipulags- og byggingarráð gerði 23.06.2009 eigendum skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki innan þess tíma mundi skipulags- og byggingarráð gera tillögu til bæjarstjórnar um að beitt verði dagsektum skv. 57. grein skipulags- og byggingarlaga nr. 73/1997 þar til bætt verður úr. Lagðir fram minnispunktar skipulags- og byggingarsviðs, þar sem fram kemur að beðið hefur verið um frest til að bregðast við málinu þar til unnt er að halda húsfund, sem hefur verið boðaður 07.09.2009. Skipulags- og byggingarráð féllst á að veita umbeðinn frest. Frekari skýringar bárust ekki að þeim tíma liðnum. Greint frá fundi skipulags- og byggingarsviðs með Ívari Erlendssyni fulltrúa eigenda hússins, sem neitaði því að þar væri búseta, en varnaði skoðunarmanni inngöngu til að sannreyna það. Skipulags- og byggingarfulltrúi vísaði því til skipulags- og byggingarráðs, sem samþykkti eftirfarandi 20.10.2009:%0D“Skipulags- og byggingarráð gerir kröfu um að byggingarstjóri verði settur á húsið innan tveggja vikna og boði þá þegar til stöðuúttektar. Einnig gerir skipulags- og byggingarráð þá kröfu að eftirlitsmanni skipulags- og byggingarsviðs verði tafarlaust veittur aðgangur til að sannreyna hvort búseta sé í húsinu. Verði ekki brugðist við hvoru tveggja innan tveggja vikna mun skipulags- og byggingarráð gera tillögu til bæjarstjórnar um að beitt verði dagsektum í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997.“%0DLagt fram bréf frá Ívari Erlendssyni dags. 06.11.2009, þar sem farið er fram á eins mánaðar frest til að skila inn reyndarteikningum af húsinu og framkvæma tilskyldar úttektir. Bréfritari telur óþarft að veita eftirlitsmanni aðgang að húsinu til að rannsaka hvort búseta sé í húsinu, og segir að byggingarstjóri verði settur á húsið (ótímasett). Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 04.11.2009, sem telur að nógir tímafrestir hafi þegar verið veittir, og leggur til við skipulags- og byggingarráð að málinu verði fram haldi eins og lagt var til á fundi ráðsins 20.10.2009. Þ.m.t. að eftirlitsmanni byggingarfulltrúa verði tafarlaust veittur aðgangur að húsinu til að kanna hvort þar sé búseta.

    The Planning and Building Committee endorses the recommendation of the Planning and Building Officer and denies a further extension of time on the matter.;

  • 0908083 – Norðurhella 19, containers on the plot

    Á lóðinni Norðurhella 19 eru tveir gámar sem ekki er stöðuleyfi fyrir. Skipulags- og byggingarfulltrúi gerði 12.08.2009 lóðarhafa skylt að sækja um stöðuleyfi fyrir gámana innan tveggja vikna í samræmi við grein 71.2 í byggingarreglugerð eða fjarlægja þá að öðrum kosti. Yrði ekki brugðist við þessu mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta í samræmi við grein 57.1 í skipulags- og byggingarlögum nr. 73/1997. Skipulags- og byggingarfulltrúi vísaði erindinu til skipulags- og byggingarráðs, sem bókaði eftirfarandi 20.10.2009:%0D“Skipulags- og byggingarráð gerir lóðarhafa skylt að sækja um stöðuleyfi fyrir gámana innan tveggja vikna í samræmi við grein 71.2 í byggingarreglugerð eða fjarlægja þá að öðrum kosti.     The Planning and Building Committee makes the following recommendation to the Town Council: “The Town Council of Hafnarfjörður approves that previously announced daily fines for plot holders will be kr. 20,000/day and shall be collected from 1 January 2010, if the containers have not been removed by that time.“;

  • 0809056 – Dalshraun 13, alteration Building permit

    Húsaleiga ehf sótti 04.09.08 um allsherjar endurnýjun, 40 starfsmannaíbúðir á Dalshrauni 13, samkvæmt teikningum Jóns Hrafns Hlöðversonar dags. 13.08.08. Skipulags- og byggingarráð óskaði eftir nánari gögnum. Lagt var fram bréf Heilbrigðiseftirlits Hafnarfjarðar- og Kópavogssvæðis dags. 12.12.2008, þar sem umsókn um starfsleyfi fyrir stafsmannabústað var synjað. Skipulags- og byggingarráð synjaði erindinu og vakti athygli á umsögn Heilbrigðiseftirlits að óheimilt sé að leigja út íbúðarhúsnæði eða íbúðarherbergi nema húsnæðið hafi hlotið samþykki byggingarnefndar, skv. ákvæðum 24. greinar reglugerðar um hollustuhætti nr. 941/2002. Skipulags- og byggingarráð tók jafnframt undir þá kröfu Heilbrigðiseftirlitsins að hætt verði að nota húsnæðið sem starfsmannabústað og íbúðarhúsnæði og að búsetu verði þá þegar lokið í húsinu. Enn er búseta í húsinu. Skipulags- og byggingarfulltrúi gerði 02.09.2009 eigendum húsnæðisins skylt að ljúka búsetu í húsinu þriggja vikna. Yrði það ekki gert mundi skipulags- og byggingarfulltrúi vísa erindinu til skipulags- og byggingarráðs með tillögu um dagsektir í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997. Ekki hefur verið brugðist við erindinu. Skipulags- og byggingarfulltrúi vísaði erindinu til skipulags- og byggingarráðs, sem bókaði eftirfarandi 20.10.2009:%0D“Skipulags- og byggingarráð gerir eigendum húsnæðisins skylt að ljúka búsetu í húsinu innan þriggja vikna. Verði það ekki gert mun skipulags- og byggingarráð vísa erindinu til bæjarstjórnar með tillögu um dagsektir í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997.“ Eigandi hefur sagt að úrbætur verði gerðar, en ekkert staðfest liggur þar fyrir.%0D

    The Planning and Building Committee makes the following recommendation to the Town Council: “The Town Council of Hafnarfjörður approves that the previously imposed daily fines on Húsaleiga ehf shall be kr. 50,000 per day and to be collected from 1 January 2010, if the occupation has not been completed by that time, or if sufficient documentation from the Hafnarfjörður and Kópavogur District Health Office and the Fire Service has not been submitted.“
