    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's disposal meetings of 21.10.2009 and 28.10.2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 09103112 – Hverfisgata 29, lift house

      Thorsteinn Friðþjófsson, on behalf of the property owners, has submitted a letter dated 01/10/2009 requesting an amendment to the detailed plan for the plot to accommodate a lift house. The application was considered at the planning and building officer's meeting on 21 October 2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee rejects the application as it stands. It is proposed that a solution is found within the existing staircase.;

    • 0807220 – Suðurgata - Hamarsbraut, detailed plan

      To reconsider the proposal from the Planning and Building Department, dated 18.09.2009, for a detailed plan for a site bounded by cliffs north of the houses north of Hellubraut/Hamarbraut, Suðurgata, Mýrarhóll and Strandgata. Previously submitted: the 2009 archaeological survey of the area by the Hafnarfjörður Folk Museum and the opinion of the House Preservation Committee regarding Hellubraut 7, dated 05.05.2009. Previously submitted were the minutes and responses to comments from the preliminary presentation meeting of 25 May 2009. Previously submitted were the minutes of the Planning and Building Department regarding area conservation. A new report and plan dated 30 September were previously submitted. Previously submitted documents dated 10 January 2009 and from the Planning and Building Department dated 8 October 2009. The Director of the Department reports on discussions with the owner of Hellubraut 9 regarding the plot boundaries.

    • 0903141 – Jófríðarstaðir, detailed plan for the Catholic Church and Búmenn

      The proposal by Búmenn, on their own behalf and on behalf of the Catholic Church, for a detailed plan for service flats, etc., at Staðarhvamm, was reconsidered, based on drawings and models by architect Guðrún Jónsdóttir. A revised drawing, dated, was presented. 12.10.2009, where parking spaces have been changed. Previously, a plan was submitted by the Hafnarfjörður Folk Museum and the Planning and Building Department, showing protected steps and a cairn. The Planning and Building Department outlines the position of the Catholic congregation.

    • 09102693 – Ölduslóð 12, enquiry

      To reconsider the query from Gísli G. Gunnarsson, building surveyor, on behalf of the owners of the house at Ölduslóð 12, regarding the raising of the house's roof.

      The Planning and Building Committee rejects the application as it stands, as it deviates in several respects from the current detailed plan in terms of height, scale and form.;

    • 0901068 – Hamranes outline plan.

      The proposal by Arkitektur.is for a master plan for the Hamraness area was reconsidered. Minutes from the working meetings of 03.09.2009, 24.09.2009 and 22.10.2009 were presented. Páll Tómasson of Arkitektur.is, Þráinn Hauksson of Landslag and Stefán Veturliðason of VSB engineering firm attended the meeting.

      The Planning and Building Committee thanks the presenter. The Planning and Building Committee refers the matter for presentation to the Environment Committee/Std 21.;

    • 0901069 – Asland framework plan

      The proposal from Batteríið for a master plan for Ásland and Vatnshlíð was reconsidered. Minutes from the working meetings of 10 September 2009 and 29 October 2009 were presented. Sigurður Einarsson of Batteríinu, Þráinn Hauksson of Landslag and Stefán Veturliðason of VSB Engineering Consultants attended the meeting.

      The Planning and Building Committee thanks the presenter. The Planning and Building Committee refers the matter for presentation to the Environment Committee/Std 21.;

    • 0809375 – Ásvellir, Haukasvæði, amendment to the local plan.

      The proposal by landscape architect Pétur Jónsson, dated 15.02.2009, for a change to the detailed plan for the Haukar sports grounds at Ásvellir, together with an explanatory drawing, is reconsidered. A new drawing, dated 02.04.2009, has been received. The proposal was advertised on 24 August 2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997. The deadline for comments was 6 October 2009. A comment was received from Ask Architects dated 10 September 2009.

    • 0903036 – Master Plan of Hafnarfjörður, amendment Sléttuhlíð

      The proposal from the Planning and Building Department dated 04.03.2009 for an amendment to the Hafnarfjörður 2005–2025 Master Plan, concerning an increase in the Sléttuhlíð settlement area, is reconsidered. Text amendment. The planning proposal was advertised on 24 August 2009 in accordance with Article 18 of the Planning and Building Act No. 73/1997, and the consultation period closed on 9 October 2009. Comments were received. A summary of the comments received and a proposal for responses were presented by the Planning and Building Department.

      The minutes of the Environment Committee/Local Agenda 21 meeting of 28 October 2009 were presented.

    • 0812022 – Southwest Lines, electricity transmission system

      A letter from the Committee Office of the Althingi, dated 22 October 2009, was presented, referring to the review of the motion for a parliamentary resolution on the revocation of the Environment Minister's decision concerning the South-West Line.

      The Planning and Building Council agrees to instruct the Director of the Planning and Building Department to send the parliamentary committee a copy of the report on the Southwest Line, which was sent to the Planning Authority last October.

    A letter from the Ministry of Fisheries and Agriculture, dated 08.10.2009, was presented, announcing a working group for the review of the Land and Tenure Act. Comments and viewpoints that could be useful to the group are requested by 10.11.2009.

    A letter from the board of Reykjanes National Park, dated 12 October 2009, was presented, in which support for the 'Volcano Park' project is sought.

  • 0811157 – Titan Global ehf, plot for a data centre

    Notes from the Director of the Department from a meeting with Titan Global on 10.09.2009, together with an email and a letter from Jónas Tryggvason, the company's CEO, dated. 28.10.2009, requesting a commitment for up to 18 months for a plot at Kapelluhraun Phase 1.

    The Planning and Building Committee welcomes the proposal and refers it to the Town Council.;

    A ruling of the assessment committee for compensation for compulsory purchase, dated 23 October 2009, concerning land of the State Forestry in Hellnahraun 3, was presented.

  • 0909237 – Citizens' Assembly 2009

    The proposal from the Environment Committee/SD 21, from the meeting of 30 September, regarding the preparation of a citizens' assembly was taken up again. The Environment Committee/SD 21 requested that the Planning and Building Council begin preparations for a citizens' assembly, focusing on the framework plan for the upland area, the development plan for the town centre, and the harbour authority's proposals for a new harbour west of Straumsvík. At its meeting on 6 October 2009, the Planning and Building Committee proposed that a working group be established, comprising four representatives from the Committee and the Council, in addition to the existing official working group. Rósa Guðbjartsdóttir then requested that plans for the implementation and the associated costs of the citizens' assembly be presented at the next meeting. At the last meeting, the following were appointed to the working group: Gisli Valdimarsson, chair, Guðfinna Guðmundsdóttir and Guðrún Ágústa Guðmundsdóttir. The Independence Party deferred their nomination. An email from Steinunn Þorsteinsdóttir regarding the cost and implementation of the assembly was presented. Steinunn Þorsteinsdóttir and Anna Sigurborg Ólafsdóttir attended the meeting and discussed ideas for the implementation and cost of such a citizens' assembly.

  • 0908248 – Ring Road 8, construction stage and use

    According to the property register, the building is still listed as being at construction stage 1, even though it is fully completed and has been put into use, and that the legally required inspections have not been carried out, including the certificate of occupancy inspection. According to the terms, the building was to be shell-complete on 15 March 2007 and fully completed on 15 August 2007. On 2 September 2009, the planning and building officer required the owners to provide information on the matter within two weeks. If these are not received, the matter will be referred to the Planning and Building Committee with a proposal for a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997. No information has been received. The planning and building officer referred the matter to the planning and building committee, which on 06.10.2009 required the owners to provide information about the matter within two weeks. If these were not received, the matter would be referred to the town council with a proposal for a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997.

    “The Hafnarfjörður Town Council resolves that the previously announced daily fines for the property owner and the building supervisor shall be kr. 20,000 per day for each of them, and to be collected from 1 December 2009, if information has not been received by that time.“ article of the building regulations, the Planning and Building Board also agrees that the building supervisor will be issued a warning in the event of a repeat offence, in accordance with article 59 of the Planning and Building Act No. 73/1997.;

     “The Hafnarfjörður Town Council resolves that previously announced daily fines for the property owner and the building supervisor shall be kr. 20,000 per day for each of them, and shall be collected from 1 December 2009, if information has not been received by that time.“As this constitutes a breach of Article 48 of the Building Regulations, the Planning and Building Board also resolves that the building surveyor shall be issued with a reprimand for a repeat offence, in accordance with Article 59 of the Planning and Building Act No. 73/1997.

Samkvæmt skilmálum átti húsið að skilast fokhelt 7. október 2008 og fullbúið 7. apríl 2009. Skipulags- og byggingarfulltrúi gerði 23.09.2009 eigendum og byggingarstjóra skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki yrði málinu vísað til skipulags- og byggingarráðs með tillögu um dagsektir skv. 57. grein skipulags- og byggingarlaga nr. 73/1997. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 21.10.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð gerir eigendum og byggingarstjóra skylt að veita upplýsingar um málið innan tveggja vikna.     The Planning and Building Committee requires the owners and the building supervisor to provide information on the matter within two weeks. If this information is not received, the matter will be referred to the Town Council with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.

  • 0906198 – Holtsgata 12, load-bearing wall

    In a letter dated 22 June 2008, Jónína G. Hjaltadóttir requests a remedy, namely that the owner of the lower floor install a load-bearing column in place of the load-bearing wall he demolished without permission. On 24 June 2009, the Planning and Building Officer pointed out that the alteration is a breach of the Planning and Building Act, Article 43.1, and required the owner of the lower floor to submit building and structural plans within four weeks of the date of the meeting on 24 June 2009. Failure to do so would result in the Planning and Building Officer referring the matter to the Planning and Building Committee with a recommendation for a daily fine in accordance with section 57.1 of the Planning and Building Act No. 73/1997. The planning and building officer referred the matter to the planning and building board, which on 25 August 2009 required the owner of the lower floor to submit the building permit drawings and structural drawings within four weeks. Failure to comply would result in the Planning and Building Committee referring the matter to the town council with a proposal for a fine in accordance with section 57.1 of the Planning and Building Act no. 73/1997. No response has been received.

    The Planning and Building Committee submits the following proposal to the Town Council: “The Town Council of Hafnarfjörður approves that previously imposed daily fines on the property owner will be kr. kr. 20,000 per day and shall be collected from 1 December 2009, if the aforementioned documents have not been received by that time.“;

  • 0806025 – Stekkjarkinn 5, work on the uninsulated loft.

    An enquiry has been received as to whether the work on the internal fit-out of an uninsulated loft space is in accordance with the issued building permit. Clarifications were repeatedly requested from the property owner, but no response was received. An inspection by the surveyor has revealed that work has been carried out without the required permit. On 17 February 2009, the Planning and Building Officer referred to section 43(1) of the Planning and Building Act and required the owner to either remove the works carried out without the required permit, or alternatively apply for a permit for them, within four weeks. Should the request not be complied with, the Planning and Building Officer would recommend to the Planning and Building Committee that a fine be imposed in accordance with Article 57, paragraph 1 of the Planning and Building Act No. 73/1997. The matter was considered at a case-handling meeting of the planning and building officer on 25 March 2008, who referred it to the planning and building committee with the following recommendation: „The Planning and Building Committee directs the property owner to either remove the works that have been carried out without a permit, or apply for a permit for them, otherwise within four weeks. If this is not complied with, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“ The Planning and Building Committee deferred the matter on 07.04.2009 as a building permit application had been received. The drawings were severely lacking, and therefore sufficient documentation has not yet been received. On 25 August 2009, the Planning and Building Committee required the property owner to remove the unauthorised works, or alternatively to submit a sufficient application for a permit for them in accordance with section 12.2 of the Building Regulations, within four weeks. Failure to comply would result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed, in accordance with Article 57 of the Planning and Building Act No. 73/1997. The requested documents have not been received.

    The Planning and Building Committee submits the following proposal to the Town Council: “The Town Council of Hafnarfjörður approves that previously imposed daily fines on the property owner will be kr. Kr. 20,000 per day and to be collected from 1 December 2009, if the aforementioned documents have not been received by that time.“;

  • 0911014 – Strandgata 53, grant of a leasehold agreement

    Gerður Guðjónsdóttir, on behalf of the Municipality of Hafnarfjörður, requests authorisation to enter into a lease agreement for the plot of land no. 53 at Strandgata.

    The Planning and Building Committee welcomes the proposal and refers it to the Town Council.;

  • 0911015 – Sólvangsvegur 2, issue of a lease agreement

    Gerður Guðjónsdóttir, on behalf of the Municipality of Hafnarfjörður, requests authorisation to enter into a lease agreement for plot no. 2 at Sólvangsveg.

  • 09103144 – Mobile sausage van

    Wilhelm Albrecht is requesting a site for a hot dog van in the centre of Hafnarfjörður, in accordance with the application dated 27.10.2009. The application was considered at the service meeting of the Planning and Building Officer on 28/10/2009, which referred it to the Planning and Building Committee.

    The Planning and Building Committee postpones the matter.;

  • 0802184 – Strandgata 57, Viking Hotel, test drawings

    Fjörukráin ehf leggur inn reyndarteikningar þann 26.02.08 með samþykki eldvarnareftirlits. Teikningar hannaði Jón Þór Þorvaldsson. dags. 14.03.06. Skipulags- og byggingarfulltrúi frestaði erindinu 10.06.2009 þar sem innsend gögn voru ófullnægjandi. Skipulags- og byggingarfulltrúi gerði 02.09.2009 eiganda skylt að gera skil á þeim. Yrði það ekki gert innan fjögurra vikna mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 28.10.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Þar sem samþykktar teikningar liggja enn ekki fyrir gerir skipulags- og byggingarráð eiganda skylt að gera skil á þeim.     As the approved plans have not yet been submitted, the Planning and Building Committee requires the owner to submit them. If this is not done within four weeks, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.
