    • SB040377 – Minutes of the Planning and Building Officer

      Minutes of the planning and building officer's disposal meetings of 09.09.2009 and 16.09.2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0909122 – Kaplahraun 15, alteration

      FM Properties 1 Ltd and FM Properties 2 Ltd applied on 15.09.09 to convert staff flats on the 2nd floor of the building in place of offices. The Fire Service and the Health Service have both visited the site, and their comments have been addressed. in accordance with drawings by Sigurður Þorvarðarson dated 10.09.09. A stamp from the health authority was also received. The matter was discussed at the processing meeting of the Planning and Building Officer on 16 September 2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee postpones the matter.;

    • 0809132 – Dalshraun 15, alteration, building permit

      Nýver ehf sækir 11.09.08 um leyfi til að breyta funda-veislu og sýningarsal í gistiheimili á Dalshrauni 15 samkvæmt teikningum Davíð Karls Karlssonar dags. 11.06.08. Nýjar teikningar bárust 20.05.09%0DNýjar teikningar bárust 30.06.2009 einnig stimpil frá heilbrigðiseftirliti. Stimpill frá Slökkviliði Höfuðborgarsvæðisins 13.05. 2009. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 09.09.2009, sem vísaði því til skipulags- og byggingarráðs.

      The Planning and Building Committee postpones the matter and instructs the Planning and Building Department to carry out an assessment of the premises in accordance with the submitted drawings.;

    • 0810289 – Skútahraun 11, fenced plot.

      A letter from Rúnu S. Geirsdóttir, solicitor, was presented. on behalf of the owners of Skútuhraun 11, requesting that the revocation of the building permit be reconsidered and that the council's previous decision to halt the works, pending a legal ruling on a servitude over the plot, be upheld. The matter was considered at the working meeting of the Planning and Building Officer on 16 September 2009, who referred it to the Planning and Building Committee.

      The Planning and Building Committee refers the matter to the legal counsel of the Planning and Building Department for an opinion.;

    • 0807220 – Suðurgata - Hamarsbraut, detailed plan

      To reconsider the proposal from the Planning and Building Department, dated 18.09.2009, for a detailed plan for a site bounded by cliffs north of the houses north of Hellubraut/Hamarbraut, Suðurgata, Mýrarhóll and Strandgata. Previously submitted: the 2009 archaeological survey of the area by the Hafnarfjörður Folk Museum and the opinion of the Buildings Preservation Board regarding Hellubraut 7, dated 05.05.2009. Previously submitted were the minutes and responses to comments from the preliminary presentation meeting of 25 May 2009. Submitted were the minutes of the Department of Planning and Building regarding area conservation.

      Rósa Guðbjartsdóttir draws attention to a report by experts commissioned by the City of Hafnarfjörður have experts conduct in 2002 on the policy for house preservation in Hafnarfjörður, where the property at Hellubraut 7 is not considered among the houses that should be protected.

      Trausti Baldursson points out that it appears to be an error on the part of the report's authors, as on the explanatory map the colour for houses built before 1918 is used, but the house in question is not shown in that colour.

    • 0909069 – Master Plan Suðurgata - Hamarsbraut

      A proposal from the Planning and Building Department for an amendment to the Master Plan of Hafnarfjörður 2005–2025, concerning the St. Joseph's Hospital site within the Suðurgata – Hamarsbraut detailed plan area, dated 16.09.2009, was presented. It is proposed that the land use on the plots at 42–44 Suðurgata be changed from an institutional area to a mixed residential and institutional area.

      The Planning and Building Committee agrees that the draft general plan, with the amendments made to the text, shall be advertised in accordance with Article 18 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the Town Council: “The Town Council of Hafnarfjörður approves that the proposal for the Master Plan for Suðurgata – Hringbraut, dated. 18.09. 2009 be published in accordance with Article 18 of the Planning and Building Act No. 73/1997.“;

    • 0805284 – Master Plan of Hafnarfjörður, changed land use east of Skútahraun

      The director's proposal to change the land use from an industrial area to a business area for the area bounded by Hólshraun to the north, the right-of-way for the proposed Álftanesvegur, and the municipal boundary with Garðabær to the east, was reconsidered. Stapahrauni to the south and houses east of Bæjarhraun to the west. The change would allow for staff accommodation and guesthouses on the site, subject to the relevant conditions, and would also improve its environment compared to the current situation. Previously submitted, a summary by the Department of Planning and Building on the environmental impact of businesses in the area, dated 30.03.2008.

    • SB040347 – Environment Committee/Agenda 21

      The minutes of the Environment Committee/Local Agenda 21 from 09.09.2009 and 16.09.2009 were presented.

    • 0905152 – Hvaleyrarbraut 35, illegal occupation.

      Information has been received that the house is being occupied illegally. It has also been reported that the property is still registered at construction stage 1 and that the required inspections have not been carried out, including the certificate of occupancy. On 20 May 2009, the Planning and Building Officer required the owners to provide information on the matter within two weeks. If this information was not received, the matter would be referred to the Planning and Building Committee with a proposal for appropriate action in accordance with the Planning and Building Act. No response was received. On 10 June 2009, the Planning and Building Officer referred the matter to the Planning and Building Committee. On 23 June 2009, the Planning and Building Committee required the owners to provide information about the matter within two weeks. If they were not received within that time, the Planning and Building Committee would make a proposal to the Town Council to impose a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997 until the matter is rectified. Memorandum from the Planning and Building Department was presented, stating that an extension of time to respond to the matter has been requested until a house meeting, which has been called for 07.09.2009, can be held. The Planning and Building Committee agreed to grant the requested extension. No further clarification has been received. The matter was discussed at the planning and building officer's disposal meeting on 16 September 2009, which referred it back to the planning and building committee.

      The Planning and Building Committee requires the building surveyor to submit the building's inspection history and to arrange a site inspection within two weeks. Failure to comply will result in the Planning and Building Committee recommending to the Town Council that a fine be imposed in accordance with section 57 of the Planning and Building Act No. 73/1997, for breaches of sections 48 and 53 of the Building Regulations. In the event of repeated breaches, the Planning and Building Committee will consider issuing a reprimand to the building supervisor.;

    • 0903168 – Reykjavíkurvegur 50, Krónan, site maintenance

      Tekið fyrir að nýju mál Smáragarðs f.h. Krónunnar Reykjavíkurvegi 50, en bæjarstjórn Hafnarfjarðar hefur lagt dagsektir á fyrirtækið frá og með 1. september s.l. vegna umgengni á lóð. Lagt fram bréf Benedikts Inga Tómassonar f.h. Krónunnar þar sem settar eru fram tillögur um umgengni við gámana og dagsektum mótmælt þar sem gámar hafi verið sýndir á teikningu fyrir verslunina Nóatún árið 2001 og andmælafrestur verið of stuttur. Talið er í bréfinu að kröfur Hafnarfjarðarbæjar séu óljósar og ekki komi fram hvers krafist er. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 16.09.2009. %0DSkipulags- og byggingarfulltrúi fellst ekki á skýringar varðandi tímafresti o.fl. sem fram koma í bréfinu. Ítrekað hafa verið send bréf til Krónunnar og eignarhaldsfélagsins Smáragarðs allt frá 18. júní s.l. þar sem Skipulags- og byggingarfulltrúi gerir byggingaraðila skylt að ganga þannig frá gámunum að ekki sé til lýti og óþæginda fyrir nágrannna að viðlögðum dagsektum skv. 57. grein skipulags- og byggingarlaga nr. 73/1997. Til að bæta útlit gámanna þyrfti að klæða þá af á einhvern hátt, hver sem staðsetning þeirra verður. Enn fremur er bent á að sótt var um byggingarleyfi fyrir breytingum á verslunarrýminu þegar Krónan tók við húsnæðinu af Nóatúni, en það byggingarleyfi hefur ekki öðlast gildi þar sem það var skilyrt skilum á skráningartöflu, sem enn hefur ekki borist. Ekki er því fyrir hendi gilt byggingarleyfi og tilvísun í slíkt því ekki marktæk.%0DSkipulags- og byggingarfulltrúi getur fyrir sitt leyti fallist á þann frágang sem sýndur er í bréfi Smáragarðs, en vísar erindinu að öðru leyti til skipulags- og byggingarráðs.

    • 0906216 – Planning matters and plot allocations, request for information

      A letter from the Competition Authority regarding planning matters and plot allocations, dated 24.06.2009, was presented for information. On 09.07.2009, the Town Council instructed the Planning and Building Department to consider the letter and provide a response. A response from the Director, dated 14 September 2009, was presented for information.

      Discussion following a site visit on 17 September 2009, including the location of the golf course.

    • 0702005 – Master Plan of Hafnarfjörður, power lines and substations.

      A proposal from the Department of Planning and Construction for an amendment to the 2005 Master Plan of Hafnarfjörður was presented. – 2025 with regard to the electricity transmission system, to align with Landsnet's plans for strengthening the electricity transmission system in Southwest Iceland and the agreement between Hafnarfjörður and Landsnet on the matter, which was approved by the town council on 11 November 2008. The changes concern power lines and underground cables from Geithálsi and Sandskeiði to existing and planned substations in Hafnarfjörður, and from there to the aluminium smelter in Straumsvík and to the Reykjanes Peninsula. The draft local plan is based on the municipal council's resolution on the preparation of the plan dated 11 November 2008. The environmental report by the engineering firm Efla, dated 29 July 2009, was presented. A preliminary information meeting was held on 7 September 2009. The opinion of the Planning Authority on the preliminary assessment report, dated 17 September 2009, and the final assessment report by Efla and Landsnet, dated 10 August 2009, were presented.
