    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's disposal meetings of 25 March 2009 and 1 April 2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0903249 – Hafnarfjörður Paintball Club, competition area

      The Hafnarfjörður Paintball Club is requesting an extension of the use of the training and competition area at Krýsuvíkurveg. A licence for earthworks is also requested. The application was considered at the processing meeting of the Planning and Building Officer on 1 April 2008, which referred it to the Planning and Building Committee.

      The Planning and Building Committee refers the matter to the Environment Committee/Local Agenda 21, the Operations Department and the Family Services Department for comment.;

    • 0902146 – Sléttuhlíð F8, building permit, garden house

      On 11.02.09, Eyjólfur Haraldsson submitted an application for planning permission to place a garden house on the plot of Sléttuhlíðar F8, land number 123150. See attached documents. A new drawing was received along with additional documents on 26 March 2009. The application was discussed at the planning and building officer's meeting on 1 April 2009, which referred it to the planning and building committee.

      The Planning and Building Committee has no objection to the application.

    • 0903068 – Fjarðargata 13-15, sign

      Eldborg, Kiwanis Club applies on 06.03.2009 for a renewal for a sign that was approved on 28.04.2004, according to drawings by Sveinbjörn Hinriksson. Submissions from the Executive Department, which raised no objections, and the City Centre Committee, which opposes the granting of permission, were presented. The application was considered at a disposal meeting of the Director of Planning and Building on 18 March 2009, which referred it to the Planning and Building Committee. The planning and building officer also requested the city centre committee's reasoning for its decision, which is now available. Postponed at the 222nd meeting.

      The Planning and Building Committee postpones the matter.;

    • 0809375 – Ásvellir, Haukasvæði, amendment to the local plan.

      The proposal by landscape architect Pétur Jónsson, dated 15.02.2009, for an amendment to the detailed plan for the Haukar sports grounds at Ásvellir, together with an explanatory drawing, is reconsidered. A new drawing, dated 02.04.2009, has been received.

      The Planning and Building Committee agrees that the outline planning proposal shall be advertised in accordance with Article 26, paragraph 1 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the Town Council: “The Town Council of Hafnarfjörður approves that a proposal for the detailed plan for Ásvellir, Haukasvæði, dated. 02.04.2009 for advertisement pursuant to the 1st paragraph of Article 26 of the Planning and Building Act No. 73/1997.“;

    • 0803116 – Sewerage, regulation/by-law

      A regulation for the Hafnarfjörður Sewerage System was presented. Kristján Stefánsson, supervisor of sewerage works, presented the proposal.

    • 0903210 – Gunnarssund 9, enquiry

      On 25.03.09, Arkur ehf submitted an enquiry to build a new house, one storey with an attic, on the plot, in accordance with information from Jon Nordsteien. The application was considered at the processing meeting of the Planning and Building Officer on 01/04/2008, which referred it to the Planning and Building Committee.

      The Planning and Building Committee welcomes the application, which requires an amendment to the 1981 town centre local plan. The application is referred to the Hafnarfjörður Folk Museum for comment.;

    • 0904003 – Greenacres 4 planning application amendment

      A proposal from the Planning and Building Department was presented for an amendment to the Kinna detailed plan for the plots Grænukinn 2 and 4 and Bröttukinn 1 and 3, in accordance with the drawing by the Planning and Building Department dated 27.03.2009. The application is in accordance with an enquiry from Stefán Ómar Jakobsson of Grænukinn 4, dated. 10.02.2009, which was dealt with at the Planning and Building Committee meeting on 10.03.09. The application was discussed at a meeting of the Director of Planning and Building on 01.04.2008, who referred it to the Planning and Building Committee.

      The Planning and Building Committee agrees to send the proposal for local consultation in accordance with the second paragraph of Article 26 of the Planning and Building Act No. 73/1997.;

    • 0709106 – New plot on Óseyrarbraut.

      A proposal from the Harbour Board for a new plot of land, No. 33 Óseyrarbraut, was discussed. The Harbour Board approved the formal finalisation of the plot's layout in accordance with the outline drawing by Al-Ark Architects, which was presented at the 1327th meeting of the Harbour Board on 23 January 2008. The Town Council referred the matter on 16/03/2009 to the Planning and Building Committee for discussion and decision. Postponed at the 222nd meeting. A new outline development plan dated 02/04/2009 was presented.

      The Planning and Building Committee agrees to send the proposal, with the amendments made, for local consultation in accordance with the second paragraph of Article 26 of the Planning and Building Act No. 73/1997.;

    • 0801344 – Town Centre, development plan

      The discussion on the city centre development plan was taken up again. A joint meeting was held with the City Centre Committee on 31 March 2009, where Bjarni Reynarsson of Land-ráð ehf attended and presented a proposal for the development plan.

      The Planning and Building Committee postpones the matter.;

    • 0903196 – Furuás 1, amendment to the building permit

      Klettar ehf apply on 23.03.09 to amend previously approved drawings. The internal layout and plot are altered in accordance with drawings by Gunnhildur Gunnarsdóttir dated 01.03.09. The application was considered at a disposal meeting of the Planning and Building Officer on 25.03.2008, which referred it to the Planning and Building Committee.

      As new information has been received, the Planning and Building Committee refers the matter back to the Planning and Building Officer.;

    • 0903197 – Furuás 3, amendment to the building permit

    • 0903198 – Furuás 5, amendment to the building permit

    • 0902154 – Lyngbarð 5 and 7, Móabarð 29, plot boundaries

      Valgerður Kristjánsdóttir, of Lyngbarði 5, on behalf of the residents of Lyngbarði 5 and 7, makes an objection to the owner of Móabarði 29 having taken a portion of their plots and fenced it off. A surveyor for the City of Hafnarfjörður has measured the plot boundaries. There are indications of planned works on the plot of Lyngbarði 5. On 11 February 2009, the Planning and Building Officer required the owner of Móabarði 29 to move the fence to the correct position in accordance with the survey by the surveyor for the City of Hafnarfjörður. If the matter is not rectified within 4 weeks, the Planning and Building Officer will refer the case to the Planning and Building Committee with a proposal for daily fines in accordance with section 210.1 of the Building Regulations. A letter from Anna Rósa Traustadóttir and Gylfi Sigurðsson, owners of Móabarð 29, dated 15.03.2009, together with lease agreements for the aforementioned houses. The matter was discussed at the planning and building officer's disposal meeting on 25.03.2008, which referred it to the planning and building committee.

      The Planning and Building Committee requests information from the owners of Lyngbarðs 5 and 7 regarding the works planned for the plots, and how they intend to finalise the boundary demarcations. Reference is made to Chapter 3 of the Building Regulations.;

    • 0709236 – Gullhella 1, temporary permit

      Hlaðbær-Colas Ltd applied on 26/09/2007 for a temporary use permit for a temporary office and service building, constructed from containers in accordance with drawings by Bjarni Vésteinsson dated 25/09/2007. A siting permit was granted on 03.10.2007 for one year, and the structure was to be removed after that period. On 24.02.2009, the planning and building officer ordered the owner to remove the structure. The matter was discussed at a meeting of the Planning and Building Officer on 25 March 2008, who referred it to the Planning and Building Committee with a recommendation for action. An application has been received for an extension of the temporary permit.

      The Planning and Building Committee agrees to extend the temporary permit for one year, until 31 March 2010. After this period, the structure is to be removed. The Planning and Building Committee requests that the plot holder properly finalises the gravel storage on the plot, and completes the entire plot in accordance with the approved plans.;

    A proposal for a contract with Batteríið ehf. dated 23.03.2009 was presented. The consultant has engaged Landslag ehf., with landscape architect Þráinn Hauksson, to assist in the preparation of the framework plan. The minutes of the works meeting dated 02.04.2009 were presented.

    A proposal for a service contract with Arkitektur.is ehf, dated 01/04/2009, was presented. The minutes of the design meeting of 26/03/2009 were presented.

  • 0803172 – High Hills by Vatnsskarð, Grindavíkurbær, quarrying

    The report by Mannvit, „Quarrying from Háuhnúkar at Vatnsskarð in Grindavík Municipality (Vatnsskarðsnáma) – Environmental Impact Assessment, Preliminary Assessment Report“, dated March 2009, was reconsidered, together with a letter from the Planning Authority dated 04.03.2009, requesting a review of the report. The deadline for comments was extended to 07.04.2009. A comment from the Head of Department, dated 19.03.2009, was previously submitted. Submitted were the opinions of the Environment Committee/Local Agenda 21 and the Executive Board/Hafnarfjörður Waterworks.

    The Planning and Building Committee concurs with the director's report.;

  • 0805284 – Master Plan of Hafnarfjörður, changed land use east of Skútahraun

    The director's proposal to change the land use from an industrial area to a business area for the area bounded by Hólshraun to the north and the right-of-way of the proposed Álftanesvegur and the municipal boundary with Garðabær to the east, Stapahrauni to the south and houses east of Bæjarhraun to the west. The change would allow staff accommodation and guesthouses on the site, subject to the relevant conditions, and would also improve its environment compared to the current situation. Previously submitted, a summary from the Planning and Building Department on the environmental impact of businesses in the area, dated 30.03.2008. Previously submitted was a report from the Planning and Building Department with a comment from the Public Health Officer for the Hafnarfjörður and Kópavogur area, dated 04.03.2009. Submitted was a comment from the Planning Authority, dated 26.03.2009.

    A calculation from the Planning and Building Department was presented regarding the special marking of parking spaces at Álfholt.

    The Planning and Building Committee agrees to proceed with the special marking of parking spaces, due to special circumstances, as a one-year trial in accordance with the Director's proposal dated 20.03.2009.;

    Fjölbýlishús. Framkvæmdaraðili Þrastarverk ehf. Skipulagi breytt 21.12.2005 og húsið hækkað um eina hæð. Byggingarleyfi samþykkt 31.08.2005. Borist hefur tölvupóstur frá stjórn húsfélagsins varðandi galla í húsinu og óskað er eftir að lokaúttekt fari fram. Skipulags- og byggingarfulltrúi beindi því 28.01.2009 til byggingarstjóra hússins að gera grein fyrir og bæta úr þeim göllum sem taldir eru upp innan fjögurra vikna. Enn fremur var honum bent á að sækja um lokaúttekt í samræmi við grein 53.1 í byggingarreglugerð. Svar hefur ekki borist. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 25.03.2008, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð beinir því til byggingarstjóra Kirkjuvalla 5 að gera grein fyrir og bæta úr þeim göllum sem taldir eru upp í bréfi húsfélagsins innan fjögurra vikna.     The Planning and Building Committee instructs the Head of Department to summon the building control manager for an interview, together with the inspector.;

  • 0902060 – Ice Cave 4, Ragnar Robertsson's Jeep parts, complaint

    A complaint has been received from Kári Harðarson on behalf of Fagstáls ehf and Þorvaldur Stefánsson on behalf of Stufs ehf regarding the conduct of the company Jeppahlutir Ragnars Róbertssonar, dated 04.02.2009. On 11.02.2009, the planning and building officer referred to section 68.2 of the building regulations and required the owner to carry out remedial work on the plot within 4 weeks. If the situation is not rectified, the Planning and Building Officer will refer the matter to the Planning and Building Committee with a proposal for daily fines in accordance with section 210.1 of the Building Regulations. An inspector from the planning and building department has confirmed that the plot is cluttered with derelict vehicles, presumably belonging to the business. The matter was considered at a work session of the Planning and Building Officer on 25 March 2008, which referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee requires the property owner to carry out improvements to the plot within 4 weeks. Should this fail to be addressed, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“

  • 0808287 – Álfaskeið 113-115, site inspection

    A complaint has been received regarding four containers located on the plot. These containers are not permitted. On 28/01/2009, the Planning and Building Officer required the property owner to remove them within two weeks. Should this not be addressed, the Planning and Building Officer will refer the matter to the Planning and Building Committee with a recommendation for action to compel remedial measures in accordance with the Building Regulations. The matter was considered at a service meeting of the Planning and Building Officer on 25 March 2008, who referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee requires the property owner to remove the said containers within two weeks. If this is not complied with, the Planning and Building Committee will make a proposal to the Town Council to impose a daily fine in accordance with section 57 of the Planning and Building Act no. 73/1997.“

  • 0806025 – Stekkjarkinn 5, work on the uninsulated loft.

    An enquiry has been received as to whether the work to fit out an uninsulated loft is in accordance with the issued building permit. Repeated requests for clarification from the property owner have gone unanswered. An inspection by the inspector has revealed that works have been carried out without the required permit. On 17 February 2009, the Planning and Building Officer referred to section 43(1) of the Planning and Building Act and required the owner to either remove the works carried out without the necessary permit, or apply for a permit for them otherwise within four weeks. Should the request not be complied with, the Planning and Building Officer would recommend to the Planning and Building Committee that daily fines be imposed in accordance with Article 57, paragraph 1 of the Planning and Building Act No. 73/1997. The matter was considered at a work session of the Planning and Building Officer on 25 March 2008, who referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee requires the property owner to either remove the works that have been carried out without a permit, or apply for a permit for them, otherwise within four weeks. Failure to comply will result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed in accordance with Section 57 of the Planning and Building Act No. 73/1997.“

    The Planning and Building Committee postpones the matter and refers it to the Planning and Building Department for consideration, as an application for a building permit has been received.;

  • 0901130 – 50 Reykjavíkurvegur, shop alteration

    Smáragarður ehf applied on 14 January 2008 for a change to a shop. A new entrance on the west side, an emergency exit on the east side, and alterations to the shop's interior, in accordance with drawings by Jóhann Sigurðsson dated 8 January 2009. Along with a stamp from the Health Authority and the Capital Region's Fire and Rescue Service. The Planning and Building Officer approved the application on 14 January 2009, upon receipt of the corrected registration table. As the registration table has not been received, the building permit has not come into effect. On 11 March 2009, the Planning and Building Officer required the owner to submit a corrected registration table within two weeks. If this was not received within the specified time, the matter would be referred to the Planning and Building Committee with a proposal for action. The matter was considered at a service meeting of the Planning and Building Officer on 01.04.2008, who referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee requires the property owner to submit a corrected registration table within two weeks. Failure to do so will result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed in accordance with Section 57 of the Planning and Building Act No. 73/1997.“

  • 0808089 – Forest Avenue A, /2 landfill below the house

    An email has been received from neighbours of Skógarás A, stating that the owner of Skógarás A has dumped all material generated by the house construction down the slope below the house, calling it 'land adoption'. There is no permit for this activity. The Planning and Building Committee has denied the owner of Skógarás A's request for a land adoption. At the Planning and Building Committee meeting on 23 September 2008, the owner of Skógarás A was given 14 days to remove the aforementioned fill. At a meeting on 10 September 2008, the planning and building officer agreed to make a proposal to the planning and building committee that daily fines be imposed in accordance with section 210.1 of the Building Regulations to compel remedial action. At its meeting on 21/10/2008, the Planning and Building Committee reiterated its decision of 23/09/2008 to remove the fill, with daily fines imposed if the fill has not been removed within 14 days. The Director of the Department and the Head of the Office previously reported on discussions with the owner of Skógarás A on 29 October 2008. The Planning and Building Committee reiterated its previous decision on 04.11.2008 regarding the removal of the soil fill, with daily fines applicable, and gave the owner of Skógarás A 14 days to remove the fill. On 10 March 2009, the Planning and Building Committee reiterated its previous decision regarding the removal of the soil fill, subject to the imposition of daily fines, and gave the owner of Skógarás A/2 14 days to remove the fill. If the remedial action has not been carried out by that time, the Planning and Building Committee will make a recommendation to the Municipal Council to impose a daily fine or to remove the fill at the expense of the owner of Skógarás A/2, in accordance with section 57 of the Planning and Building Act no. 73/1997, as amended.

    The Planning and Building Committee makes the following recommendation to the Town Council:“As the owner of Skógarás A/2 has failed to respond to repeated requests to remove a soil fill placed without permission below his house, the town council agrees that he be subject to a daily fine of 10,000 kr./per day from 01/05/2009, if he has not responded to the notice by that date.“;

  • 0805264 – Skógarás H/7, comment

    The landowner's objection to the permit granted to raise the house at Skógarás E/6 is reconsidered. A survey by the Planning and Building Department of decisions in Ásland, dated 27.06.2008, was previously presented. The Planning and Building Committee instructed the Planning and Building Department to investigate possible measures to rectify the matter in accordance with the Planning and Building Act and regulations. A letter from Björn R. Ingólfsson and Sigríður B. Guðmundsdóttir, Skógarási 7, dated 07.01.09. On 14.01.2009, the Planning and Building Officer reiterated the request for clarification from the property owners. A letter from Lúther Sigurðsson and Ingibjörg Ragnarsdóttir, dated 20.12.2007, was submitted. The matter was discussed at the planning and building officer's disposal meeting on 04.02.2008, which referred it to the planning and building committee. A summary from the head of department, dated 23.03.2009, was presented.

    The Planning and Building Committee refers the matter to the Planning and Building Department for further processing.;

  • 0711020 – Upland area of Hafnarfjörður, outline plan

    The proposal from Landslag ehf for a framework plan for the hinterland of Hafnarfjörður, dated 14 February 2008, was reconsidered. Previously, a proposal for the preliminary plan and notes from the Planning and Building Department were presented from meetings with interest groups on 11 and 20 November 2008. Drafts of the framework plan were presented at a meeting of the Planning and Building Committee on 24 March 2009.

    The Planning and Building Committee refers the matter for information to the Environment Committee/Agenda 21, the Executive Committee, the Family Committee and the Town Council.;

  • 0707015 – Master Plan of Hafnarfjörður 2005-2025 Krýsuvík, request for amendment

    To reconsider HS Orka's query to the Planning Authority regarding the assessment requirement for exploratory drilling in Krýsuvík. The opinion of the Environment Committee/Local Agenda 21 is available.

    The Planning and Building Committee has no objection to HS Orka submitting an enquiry to the Planning Authority regarding the need for an assessment of exploratory drilling in Krýsuvík.;

  • 0809132 – Dalshraun 15, alteration, building permit

    Nýver ehf applied on 11.09.08 for a permit to convert a meeting and banquet hall and a showroom into a guesthouse at Dalshraun 15. According to drawings by Davíð Karl Karlsson, dated. 11.06.08. On 13.01.2009, the Planning and Building Committee instructed the Planning and Building Department to obtain further information, including a report from the Health Authority. An application for an operating licence is not on file. It has been discovered that the building is being used as an illegal dwelling, as no approval for a residential unit has been granted by the planning and building authorities.

    The Planning and Building Board requests information from the applicant on the status of the matter within two weeks. In addition, the property owners are advised that residential occupation is not permitted in the building, and in accordance with Act No. 75/2000 m.s.br. owners of such accommodation must, no later than 1 January 2009, have obtained a permit in accordance with the Planning and Building Act for the change of use of the accommodation so that habitation becomes permissible. If such a permit is not obtained, the owner must vacate the premises and cease the unlawful use no later than 1 March 2009. Furthermore, it is noted that although an application is made for a guesthouse, this does not constitute permanent residence under the Law on Domicile, No. 21/1990, as amended.

    Failure to comply with this within two weeks will result in the Planning and Building Council recommending to the Town Council that the owner of the part of the property that has been let for residential use be subject to a daily fine in accordance with section 57 of the Planning and Building Act no. 73/1997.;
