    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's hearings of 06.01.2010 and 13.01.2010 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 1001136 – 78 Reykjavíkurvegur. Amendment to the detailed plan

      Actavis Hf sækir þann 13.01.2010 um leyfi til að breyta deilskipulagi lóðarinnar Reykjavíkurvegur 76-80 í samræmi við meðfylgjandi skipulagstillögu Úti og Inni sf, teikning nr.001 dags 12.01.2010. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa, sem gerir eftirfarandi tillögu til skipulags- og byggingarráðs:%0D“Skipulags- og byggingarráð samþykkir að deiliskipulagsbreytingin verði auglýst skv. 1. mgr. 26. greinar skipulags- og byggingarlaga nr. 73/1997.“

      The Planning and Building Committee agrees that the zoning plan amendment will be advertised in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997.;

    • 0912117 – Eyrartröð 14, alteration

      On 11.12.2009, Tor-Net ehf applies for a permit to convert the building from a B-building to a Type A building, in accordance with drawings by Gísli G. Gunnarsson dated 8.12.09. The building inspector's notes were presented. A letter from Victor Strange on behalf of TOR-NET was submitted, requesting to change the plot's utilisation ratio from 0.44 to 0.52. The matter was considered at the planning and building officer's meeting on 06.01.2010, which referred it to the Planning and Building Committee.

      The application requires a change to the detailed plan, which the applicant is authorised to prepare in accordance with Article 23 of the Planning and Building Act No. 73/1997: „The landowner or developer is, however, permitted to submit a proposal to the local council for a detailed plan or an amendment to a detailed plan at their own expense.“ The Planning and Building Committee agrees that should a proposal for a detailed plan in accordance with the application be received, it will be subject to local consultation in accordance with section 26(2) of the Planning and Building Act No. 73/1997.;

    • 0909231 – Master Plan, South Harbour

      The proposal from the Planning and Building Department, dated 1 October 2009, concerning an amendment to the Master Plan of Hafnarfjörður with regard to the South Harbour, is reconsidered. The proposal was advertised on 12 November 2009 in accordance with Section 18 of the Planning and Building Act No. 73/1997. The deadline for comments was 28 December 2009. A comment was received. A proposal from the Planning and Building Department for a response to the received comment was presented.

      The Planning and Building Committee adopts the response of the Planning and Building Department, approves the major plan amendment, and resolves that the matter be concluded in accordance with Article 18 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the City Council: “The City Council of Hafnarfjörður approves an amendment to the Master Plan of Hafnarfjörður 2005–2025, South Harbour, dated 01.10.2009 and that the matter be concluded in accordance with Article 18 of the Planning and Building Act No. 73/1997.“;

    • 0903141 – Jófríðarstaðir, detailed plan for the Catholic Church and Búmenn

      The proposal by Búmenn, on their own behalf and on behalf of the Catholic Church, for a detailed plan for service flats, etc., at Staðarhvamm, is reconsidered, in accordance with the drawings and models by architect Guðrún Jónsdóttir. A revised plan dated 12.10.2009 was presented, in which the car parks have been changed. A previously submitted plan from the Hafnarfjörður Folk Museum and the Department of Planning and Building, showing protected stone steps and a cairn, was presented. The Department of Planning and Building reports on an interview with the chairman of the Catholic parish.

      The Planning and Building Committee postpones the matter.;

    • 0901068 – Hamranes outline plan.

      The proposal by Arkitektur.is for a master plan for the Hamranes area is reconsidered. The minutes of the working meetings of 05.11.2009 and 07.01.2010, the proposal for the master plan and a draft of the phasing plan are presented. Páll Tómasson of Arkitektur.is, Þráinn Hauksson of Landslag and Stefán Veturliðason of VSB engineering firm attend the meeting.

    • 0901069 – Asland framework plan

      The proposal from Batteríið for a master plan for Ásland and Vatnshlíð was reconsidered. The minutes of the working meetings of 12.11.2009 and 17.12.2009 were presented, along with the minutes of the meeting with representatives from Garðabær on 10.12.2009, a proposal for a framework plan and a draft phasing plan. Sigurður Einarsson of Batteríinu, Þráinn Hauksson of Landslag and Stefán Veturliðason of VSB engineering firm will attend the meeting.

    • 09103144 – Mobile sausage van

      The application from Wilhelm Albrecht for a sausage van site in the centre of Hafnarfjörður, as per his letter dated 27.10.2009, is reconsidered. The application was considered at the processing meeting of the Planning and Building Officer on 28 October 2009, which referred it to the Planning and Building Committee. The Planning and Building Department reports on discussions with the applicant.

    • 0912165 – Hólshraun, mobile food van, enquiry

      The application from Dominigos Tavares Ferreia, dated 18.12.2009, for permission to place a food van at Hólshraun is reconsidered. The Planning and Building Department reports on discussions with the applicant.

    • 0708097 – Lækjargata 2, Dvergslóðin, detailed plan

      To discuss the arrangements for the work on the detailed plan for 2 Lækjargata and the surrounding area, in accordance with the decision of the Hafnarfjörður Town Council of 1 June 2008.

    • 0809375 – Ásvellir, Haukasvæði, amendment to the local plan.

      The proposal by landscape architect Pétur Jónsson, dated 15.02.2009, for an amendment to the detailed plan for the Haukar sports area at Ásvellir, together with an explanatory drawing, is reconsidered. A new drawing, dated 24.04.2009, has been received. The proposal was advertised on 24 August 2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997. The consultation period ended on 6 October 2009. A comment was received from Ask Architects dated 10.09.2009. The proposal is in accordance with amendments to the master plan, which came into effect on 23.12.2009. A report from the Planning and Building Department on the received comment was presented.

      The Planning and Building Committee adopts the report of the Planning and Building Department, approves the outline planning application with the amendment, in accordance with the comment received, that the text should make it clear that the exit will be from the self-service station onto Ásbraut. The Planning and Building Committee emphasises that safety on pedestrian and cycle routes will be ensured during the further design of the connection. The matter will be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997.
      The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves the zoning plan proposal for Ásvellir Hawk Area dated 24<SPAN style=“FONT-FAMILY: Arial; mso-bidi-font-style: italic; mso-fareast-font-family: “Bæjarstjórn Hafnarfjarðar approves the detailed planning proposal for the Ásvellir Haukasvæði area, dated 24/04/2009, and that the matter be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997.“

    • 0702084 – Flatahraun 29, registration of property.

      A letter from the Land Registry, dated 29.12.2009, giving the Department of Planning and Building the opportunity to present its views regarding the registration of the property shares of Gylfi Sveinsson and Sigríður Anna Þorgrímsdóttir in the property Flatahraun 29, Hafnarfjörður. A ruling from the Planning and Building Appeals Board dated 03.12.2009 was presented. A proposal from the Planning and Building Department for a response to the case was also presented. The matter was considered at the planning and building officer's disposal meeting on 06.01.2010, which referred it to the planning and building committee.

      The Planning and Building Council endorses the letter of response and adopts it as its own.;

    • 0808272 – Bæjarhraun 2, illegal occupation.

      To reconsider the application from Guðni Gíslason, on behalf of Hönnunarhúsið ehf, for the House Association of Bæjarhrauni 2, regarding illegal occupation of the building and alterations to spaces 02-03. A demand was made to halt the works on the sink, toilet, etc. On 19 August 2009, the Planning and Building Officer required the owners of the rooms to vacate the premises within four weeks. If this was not complied with, the Planning and Building Officer would make a recommendation to the Planning and Building Committee to impose a fine in accordance with section 57 of the Planning and Building Act No. 73/1997. The matter has not been addressed. On 20 October 2009, the Planning and Building Committee required the owners of the premises to vacate the property within four weeks. If this is not complied with, the Planning and Building Committee will make a proposal to the Town Council for the imposition of a daily fine in accordance with Article 57 of the Planning and Building Act No. 73/1997. This has not been complied with.

      The Planning and Building Committee makes the following recommendation to the town council:“The Hafnarfjörður Town Council approves the imposition of a daily fine of kr. 50,000 on the property owner, from 1 March 2010, if occupation is not completed and the illegal works removed by that date.“

    • 0909067 – Krýsuvík, huts

      Borist hefur með tölvupósti dags. 07.09.2009 fyrirspurn frá Guðna Gíslasyni um hvaða leyfi hafa verið gefin fyrir byggingum á svæði því sem hestamenn hafa við s-v hluta Kleifarvatns. Athugun skipulags- og byggingarsviðs hefur leitt í ljós að engin byggingarleyfi né stöðuleyfi eru fyrir umræddum byggingum. Á sínum tíma voru byggðar þarna hnakkageymslur, sem Aðalskipulag Hafnarfjarðar 2005 – 2025 Krýsuvík, gerir ráð fyrir að verði fjarlægðar í áföngum, en nú er risin þarna mun umfangsmeiri byggð húsa, sum þeirra ný, sem skipulags- og byggingarfulltrúi hefur farið fram á að verði fjarlægð samkvæmt 56. grein skipulags- og byggingarlaga: „Ef byggingarframkvæmd, sem fellur undir IV. kafla laga þessara, er hafin án þess að leyfi sé fengið fyrir henni og hún brýtur í bága við skipulag eða framkvæmd er hafin með byggingarleyfi sem brýtur í bága við skipulag ber byggingarfulltrúa að stöðva framkvæmdir tafarlaust og síðan skal hin ólöglega bygging, eða byggingarhluti, fjarlægð, jarðrask afmáð eða starfsemi hætt. – Hafi mannvirki, sem fellur undir IV. kafla laga þessara, verið reist án samþykkis sveitarstjórnar og hún látið hjá líða að fjarlægja það innan sex mánaða frá því að henni var kunnugt um málið skal Skipulagsstofnun láta fjarlægja mannvirkið á kostnað sveitarfélags.“ Borist hefur umsókn frá Pálmari Harðarsyni dags. 02.11.2009, þar kemur fram að hann hafi fjarlægt þrjú hús af svæðinu fyrir Krýsuvíkurnefnd Sörla, og sækir hann í staðinn um stöðuleyfi fyrir eitt hús. Skipulags- og byggingarfulltrúi synjaði þeirri umsókn, þar sem ekki er lagaheimild fyrir slíku stöðuleyfi og það samræmist ekki skipulagi. – Skipulags- og byggingarfulltrúi óskaði 11.11.2009 eftir skýringum á umræddri byggð húsa frá Pálmari Harðarsyni, Krýsuvíkurnefnd Sörla og öðrum hugsanlegum eigendum innan fjögurra vikna, m.a. hvenær og á hvaða forsendum húsin hafa risið, og vísar síðan erindinu til Skipulags- og byggingarráðs. Einnig er óskað eftir áætlun um það hvenær húsin verði fjarlægð til samræmis við áðurnefnt ákvæði í Aðalskipulagi Hafnarfjarðar Krýsuvík 2005 – 2025. Svör hafa ekki borist. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 06.01.2010, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu: Skipulags- og byggingarfulltrúi vísar erindinu til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð óskar eftir skýringum á umræddri byggð húsa frá Pálmari Harðarsyni, Krýsuvíkurnefnd Sörla og öðrum hugsanlegum eigendum innan fjögurra vikna, m.a. hvenær og á hvaða forsendum húsin hafa risið. Einnig er óskað eftir áætlun um það hvenær húsin verði fjarlægð til samræmis við áðurnefnt ákvæði í Aðalskipulagi Hafnarfjarðar Krýsuvík 2005 – 2025. Berist ekki umbeðnar skýringar innan tilskilins tíma mun skipulags- og byggingarráð fjalla um málið að nýju og ákveða viðeigandi ráðstafanir.“%0D

      The Planning and Building Committee requests clarification from Pálmar Harðarson, the Sörli Krýsuvíkur Committee and other potential owners regarding the aforementioned cluster of houses, in particular when and on what grounds the houses were erected, within four weeks. A schedule for the removal of the houses is also requested, in accordance with the aforementioned provision of the Hafnarfjörður Krýsuvík Master Plan 2005–2025. If the requested information is not received within the specified time, the Planning and Building Council will reconsider the matter and decide on appropriate measures.;
