1201596 – 55 Strandgata (1 Vikingastræti), alteration
An on-site inspection on 26 January revealed that considerable alterations have been made to the internal layout of the restaurant. The drawings were replaced on 07.05.2012. In accordance with the opinion of the House Preservation Committee, on 18/04/12 the planning and building officer required the owner to close the openings in the fire wall or submit drawings approved by the Capital Region Fire and Rescue Service. Furthermore, as-built drawings showing the completed alterations, including the relocation of stairs, are to be submitted. Failure to respond to the request within four weeks would lead the Planning and Building Officer to use the powers under the Buildings Act No. 160/2010 to compel the necessary remedial action. The owner attended an interview on 02.05.12 and requested an extension of time while the drawings were being prepared.
The Planning and Building Officer requires the owner to submit the requested drawings within 4 weeks. Failure to do so will result in the Planning and Building Officer invoking the provisions of the Buildings Act No. 160/2010 to compel remedial action.
-
1210094 – Dalshraun 5 illegal occupation
Indications have been received of an unauthorised flat and illegal occupation at Dalshrauni 5. The building is in an industrial area, and residential use is therefore not permitted, and a previous application for this purpose was refused. A tip-off has been received from one of the owners that the occupants are living in flats that are not registered as such. An on-site inspection revealed that dwellings have been created in rooms 201, 202 and 302 without any approved drawings.
As a permanent residence has been registered in the two property units registered as flats, the planning and building officer has no objections to them being used as dwellings. Further registration of flats in the building will not be permitted in accordance with the provisions of the Planning Regulations No. 400/1998, section 4.6.1, and occupation in other parts of the building is not permitted. Owners of the rooms where illegal alterations have been made must restore them to their former state.
-
1011231 – Ring Road 14, construction stage and use
Ringhellu 14, which is on an industrial estate, is registered on floor area 5 and roof area 8, but the building has been put into use. On 17.11.10, the planning and building officer required the building supervisor to apply for a final inspection within three weeks. The planning and building officer requires the owner/building supervisor to apply for a re-inspection within 4 weeks.
-
0912150 – Middle panel 4, construction stage and use
Miðhella 4 is a nearly completed house and has been put into use, but is on building site 4 and is currently roofed. The Planning and Building Officer called for a final inspection on 20 March 2012 at 15:00 in accordance with section 36 of the Building Regulations Act no. 160/2010. The building supervisor was required to take the measures stipulated by the law. Should he fail to comply, the Planning and Building Officer will invoke the provisions of Articles 56 and 57 of the same Act regarding daily fines and a reprimand. The building supervisor, Gunnar Rósinkranz, did not attend the site, but the owners subsequently contacted the officer to say the matter was being addressed.
The Planning and Building Officer requires the owner/building manager to apply for a final inspection within 4 weeks. If he fails to comply, the Planning and Building Officer will impose a daily fine in accordance with section 56 of the Act on Civil Engineering Works No. 160/2010 and will also send a request to the Civil Engineering Works Authority for a reprimand in accordance with section 57 of the same Act.

1011348 – Óseyrarbraut 6, stage of construction and use
Óseyrarbraut 6 is registered as bst 4 mst 8, despite the house appearing to be fully completed and in use. On 01.12.10, the planning and building officer required the building supervisor to apply for a final inspection within three weeks. This was not complied with, and the Planning and Building Officer scheduled a final inspection for 03.03.11. The building supervisor failed to respond to the notice. The Planning and Building Officer is scheduling a final inspection for 01.03.2012. The building supervisor was required to take the measures stipulated by law. If he fails to comply with the request, the planning and building officer will apply the provisions of Articles 56 and 57 of the same law regarding fines and a reprimand. It is noted that the building surveyor, Sigurður Bjarnason, was removed from the project in 2005, and no one was appointed in his place. All works carried out since then are therefore the responsibility of the owners. On 4 July 2012, the planning and building officer required the owners to appoint a building surveyor to apply for a final inspection within 4 weeks. If this was not complied with, the planning and building officer would add provisions from Article 56 of the Act on Civil Engineering, No. 160/2010, to compel remedial action. The as-built drawings were approved on 22 August 2012.
The Planning and Building Officer will grant owners until 01/01/13 to appoint a building surveyor who will apply for a final inspection by that date. If this is not addressed, the planning and building officer will add provisions from Article 56 of the Buildings Act no. 160/2010 to compel remedial action.
