    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the processing meetings of the Planning and Building Officer on 08.07.2009, 15.07.2009, 22.07.2009, 29.07.2009 and 05.08.2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0907148 – Hellisgata 22, side exit onto Garðavegur

      A comment was submitted from residents of Garðavegur regarding a permit for a gate from Hellisgata 22 to the car park on Garðavegur, dated 27.07.2009. The matter was discussed at the planning and building officer's disposal meeting on 29 July 2009, who referred it to the Planning and Building Committee. Memos from the Director/Planning and Building Officer, dated 6 August 2009, were presented. As the matter concerned the official duties of the Director of Planning and Building Control, he left the meeting during its consideration.

      The Planning and Building Committee considers the gate not to require planning permission, but refers matters relating to parking and road safety to the Transport Working Group.;

    • 0905003 – Reykjavíkurvegur 76-80, amendment to the detailed plan

      Actavis hf is submitting a proposal for an amendment to the detailed plan for the plots, in accordance with the drawing 'Out and In' dated 20.04.2009. The plan was advertised on 08.06.2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act no. 73/1997, and the period for comments closed on 27.07.09. No comments were received. The application was considered at a working meeting of the Town Planner and Building Control Officer on 29 July 2009, who referred it to the Planning and Building Committee.

      The Planning and Building Committee approves the outline planning application and that the matter be concluded in accordance with section 26 of the Planning and Building Act No. 73/1997.;

    • 0903173 – Hringbraut 30, building permit

      The application from Gudmundur Ýmir Bragason and Guðrún Hallgrímsdóttir of 19/03/09 to demolish a carport, build a new garage, and extend the flats on the first and second floors, in accordance with drawings by Jón M. Halldórsson, dated 17.03.09. The application was subject to local consultation. Comments were received. At its meeting on 12.05.2009, the Planning and Building Committee instructed the Planning and Building Department to prepare a summary of the comments received. New drawings were received on 4 June. On 09.06.2009, the Planning and Building Committee requested updated shadow drawings and instructed the department to present them to the landowners of Holtsgata 16 and 18, who had made comments during the neighbourhood consultation. A letter from the residents of Holtsgata 18 dated 23.07.2009 and an email from the residents of Holtsgata 16 dated 23.07.2009. New drawings dated x were submitted. The Planning and Building Department reports on a meeting with the stakeholders on 30.07.2009.

    • 0907153 – Hverfisgata-Mjósund-Austurgata-Gunnarssund zoning plan

      Discussion of preliminary concepts for the detailed planning of a site bounded by Mjósund, Austurgata, Gunnarssund and the upper boundaries of the plots of houses at Hverfisgata 31-49. Based on the decision of SBH meeting no. 228.

      The Planning and Building Council authorises the Department of Planning and Building to begin work on the detailed plan.;

    • 0903141 – Jófríðarstaðir, detailed plan for the Catholic Church and Búmenn

      A proposal is submitted by Búmenn, on his own behalf and on behalf of the Catholic Church, for a detailed plan for service flats, etc., at Staðarhvamm, in accordance with the drawings and models by architect Guðrún Jónsdóttir, who attends the meeting and presents the proposal.

    • 0804214 – Háaberg 1, build a deck etc.

      Erling Pétur Erlingsson and Auður Baldursdóttir, by letter dated 8 April 2008, apply for permission to build a sun deck on their portion of the plot no. 1 at Háaberg and for the owner of the lower floor to adjust their deck to the property boundary, lower a screen wall and not be permitted to place a hot tub on their deck. The matter was considered at the administrative meeting of the Planning and Building Officer on 29 July 2009, which referred it to the Planning and Building Committee. Previously, a letter from Erling Pétur Erlingsson and Auður Baldursdóttir, on behalf of Háaberg 1, dated 08.04.2008. A letter was submitted from Dýrleif Kristjánsdóttir of Lex Law Firm, on behalf of Ragna Bachmann Egilsdóttir and Ólafur Árnason, owners of Háabergi 1, dated 15.05.2009, notes by Ólafur Helgi Árnason, lawyer, Planning and Building Department, dated 01.07.2009.

      The Planning and Building Committee instructs the Planning and Building Officer to conclude the matter on behalf of the municipality in accordance with the Building Regulations.;

    • 0902175 – Hafnarfjörður Cemeteries, amendment to the detailed plan

      On 13 February 2009, the Board of Hafnarfjörður Cemetery applied for a change to the detailed plan to be processed as a minor amendment, in accordance with the submitted drawing by Landslags ehf dated 11 February 2009. The change consists of using the original access area and car park from Kaldárselsvegur as a burial area. The application was advertised on 10 March 2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997. The deadline for comments was 04.05.2009. No comments were received.

      The Planning and Building Committee approves the outline planning application and that the matter be concluded in accordance with section 26 of the Planning and Building Act No. 73/1997.

  • 0905242 – Strandgata 26-28, Market Square

    On 29/05/2009, Audunn Gísli Árnason, on behalf of the city centre association, applied to set up a market square and small huts (approx. 10-12 huts) in June, see attached documents. The application was considered at a working meeting of the Planning and Building Officer on 03.06.2009, which referred it to the City Centre Committee and subsequently to the Planning and Building Board.

    The matter is closed.;

  • 0801336 – North bank, surface dressing

    Proposal from Landslags ehf dated 6th May 2009 for a connection between Strandstígs and Linnetsstíg was reconsidered. Postponed at meeting 229.

    The Planning and Building Committee postpones the matter.;

  • SB050584 – Reykjanesbraut, detailed plan

    A report was made on the work of the working group on traffic safety at Hvaleyrarskóli. The minutes of the working group's meetings were presented.

    The Planning and Building Committee endorses the working group's proposal that connections over the Reykjanesbraut should be in accordance with the 2005 Hafnarfjörður Master Plan. - 2025 and the Reykjanesbraut detailed plan, which show two level crossings on this section of the Reykjanesbraut. The Planning and Building Committee recommends that the western pedestrian route be a footbridge over the Reykjanesbraut.

  • 0906072 – Breiðvangur 17, alteration of the car park and relocation of a lamppost, building permit.

    On 09.06.09, Ásta Eyjólfsdóttir applies for permission to expand a car park and relocate a lamppost and electrical cabinets, in accordance with the attached drawing. A report from the Department of Operations is available, which is negative towards the application. Postponed at the last meeting.

    The Planning and Building Committee points out that written consent from the other owners in the terraced house must be provided. Upon receipt of this, the Planning and Building Committee instructs the Planning and Building Officer to finalise the matter on behalf of the council in accordance with the Building Regulations.;

  • 0906175 – Vesturvangur 38, paving and car park

    Lára Huld Grétarsdóttir and Ari Steindórsson wish to widen the car park in front of the house in accordance with the attached documents. They also request permission to lay a new pavement. Postponed at the last meeting.

    The Planning and Building Committee authorises the implementation of a pavement alteration in accordance with option 2, in consultation with the Council's Operations Department and at its own expense. The work must be completed within two months.

  • 0905241 – 33 Hjallabraut, use of roof space, enquiry

    A question dated was submitted. 20.05.2009 from Björn Gústafsson of VSB Engineering on behalf of the residents' association of Hjallabraut 33, to convert an unused roof space into 6 flats at the south-east and south-west ends of the building, approx. 360 – 400 m² in total. The application was considered at the processing meeting of the Planning and Building Officer on 24 June 2009, which referred it to the Planning and Building Committee. Postponed at the last meeting. Gísli Valdimarsson left the meeting during the consideration of the matter.

    With reference to Articles 19 and 27 of the Act on Multiple Ownership Houses No. 26/1994, the request cannot be granted, as the consent of all co-owners is not available.

  • 0908003 – Reykjavíkurvegur 52 and Flatahraun 1, noise from industrial operations

    A letter from the Health Surveillance Authority for the Hafnarfjörður and Kópavogur area, dated 31 July 2009, was presented, detailing complaints from residents of Reykjavíkurvegur 52 and Flathraun 1 about noise from a petrol station and car wash on the neighbouring plot. The Health Surveillance Authority's investigation of the matter was reported. The matter was discussed at the planning and building officer's disposal meeting on 05.08.2009, which referred it to the planning and building committee.

    In reference to a letter from the Health Authority for the Hafnarfjörður and Kópavogur area, the Planning and Building Board directs the plot holder of Reykjavík Road 54 to tidy up the plot, and, in cooperation with the landowners of Reykjavikurvegur 52 and Flatahraun 1, take measures regarding noise from the operation towards the blocks of flats.;

  • 0906228 – Eyrartröð 16, refrigerated containers.

    Complaints have been received from neighbours regarding noise from the refrigerated containers on the site, which is particularly disruptive at night. A report from the Public Health Officer for the Hafnarfjörður and Kópavogur area, dated 13 July 2009, was submitted, along with the results of noise measurements dated. 28.07.2009. The matter was discussed at the processing meeting of the Planning and Building Officer on 29.07.2009, which referred it for presentation to the Planning and Building Committee.

    The Planning and Building Committee instructs the Planning and Building Department to monitor the progress of the matter in cooperation with the Health Authority for the Hafnarfjörður and Kópavogur area.;

  • 0905152 – Hvaleyrarbraut 35, illegal occupation.

    Information has been received that the house is being occupied illegally. It has also been reported that the house is still registered at construction stage 1 and that the required inspections have not been carried out, including the certificate of occupancy. On 20 May 2009, the Planning and Building Officer required the owners to provide information on the matter within two weeks. If this information was not received, the matter would be referred to the Planning and Building Committee with a proposal for appropriate action in accordance with the Planning and Building Act. No response was received. On 10 June 2009, the Planning and Building Officer referred the matter to the Planning and Building Committee. On 23 June 2009, the Planning and Building Committee required the owners to provide information about the matter within two weeks. If they were not received within that time, the Planning and Building Committee would make a proposal to the Town Council to impose a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997 until the matter is rectified. Memoranda from the Planning and Building Department were presented, stating that an extension of time to respond to the matter has been requested until a house meeting can be held, which has been called for 07.09.2009.

    The Planning and Building Committee agrees to grant the requested extension.;

  • 0905139 – Kaplahraun 15, illegal occupation

    It has come to light that the house is being illegally occupied. On 20 May 2009, the Planning and Building Officer required the owners to provide information on the matter within two weeks. If this information was not received, the matter would be referred to the Planning and Building Committee with a proposal for appropriate action in accordance with the Planning and Building Act. No response was received. The Planning and Building Officer referred the matter to the Planning and Building Committee on 09.06.2009. On 23.06.2009, the Planning and Building Committee required the owners to provide information on the matter within two weeks. If these were not received, the matter would be referred to the town council with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997. The department manager reports on discussions with the owner of the house.

    The Planning and Building Committee agrees to defer the matter until the next meeting.;

  • 0805247 – Vitastígur 7, unauthorised flat let

    Information has been received about a person residing in an unauthorised flat in the house. On 20 May 2009, the Planning and Building Officer required the owners to provide information on the matter within two weeks. If this information was not received, the matter would be referred to the Planning and Building Committee with a proposal for appropriate action in accordance with the Planning and Building Act. No response was received. The Planning and Building Officer referred the matter to the Planning and Building Committee on 10 June 2009. On 23 June 2009, the Planning and Building Committee required the owners to provide information about the matter within two weeks. If this information was not provided, the matter would be referred to the town council with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997. A letter from NBI-Landsbanki was presented, stating that the flat had been empty since the bank acquired it.

    The Planning and Building Committee accepts the submitted explanation and will take no further action on the matter for the time being.;

  • 0906030 – Glitvellir 37, site finishing

    Borist hefur kvörtun frá íbúum Glitvalla 29 – 43 með tölvupósti dags. 03.06.2009 vegna frágangs á byggingarsvæði Glitvalla 37, sem notuð er fyrir birgðasvæði fyrir gáma. Skipulags- og byggingarfulltrúi gerði 10.06.2009 lóðarhafa skylt að fjarlægja gámana innan tveggja vikna. Yrði ekki brugðist við því mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta skv. 57. grein skipulags- og byggingarlaga nr. 37/1997. Skipulags- og byggingarfulltrúi vísaði málinu 01.07.2009 til skipulags- og byggingarráðs. Skipulags- og byggingarráð gerði 07.07.2009 eigendum gámanna skylt að fjarlægja þá innan tveggja vikna. Yrði ekki brugðist við erindinu yrði málinu vísað til bæjarstjórnar með tillögu um dagsektir skv. 57. grein skipulags- og byggingarlaga nr. 73/1997. Lagt fram bréf Leiknis Ágústssonar og Tinnu Bjarkar Halldórsdóttur lóðarhafa dags. 09.07.2009 þar sem gerð er grein fyrir málinu. Lagðar fram athugasemdir eftirlitsmanns skipulags- og byggingarsviðs dags. 24.07.2009.%0D

    As the plot holder has informed that he will carry out improvements to the plot, the Planning and Building Committee is deferring the matter until its next meeting.;

  • 0804310 – Miðvangur 41, flat 205, alterations

    Borist hafa athugasemdir frá stjórn húsfélagsins Miðvangi 41 dags. 22.04.2008 þar sem segir að ólöglegar framkvæmdir séu í gangi í íbúð 205. Við vettvangsskoðun hefur komið í ljós að verið er að framkvæma breytingar án tilskilins leyfis. Íbúðareiganda var 14.05.2008 gert að stöðva framkvæmdir þá þegar í samræmi við 56 gr. skipulags- og byggingarlaga. Samkvæmt upplýsingum er búið að opna milli stofu og svala og verið að endurgera íbúðina. Skipulags- og byggingarfulltrúi óskaði 06.05.2009 eftir teikningum sem sýna umræddar framkvæmdir, einkum hvort breytt hafi verið burðarvirki hússins. Ekkert svar barst. Skipulags- og byggingarfulltrúi gerði 03.06.2009 íbúðareiganda skylt að skila inn teikningum af breytingunum innan 4 vikna. Yrði ekki brugðist við því mundi skipulags- og byggingarfulltrúi leggja til við skipulags- og byggingarráð að beitt verði dagsektum í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997. Skipulags- og byggingarfulltrúi vísaði málinu 08.07.2009 til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð gerir íbúðareiganda skylt að skila inn teikningum af breytingunum innan 4 vikna. Failure to do so will result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed in accordance with section 57 of the Planning and Building Act No. 73/1997.;

  • 0907051 – Steinhella 5, illegal occupation

    Bréf barst frá Slökkviliði Höfuðborgarsvæðisins varðandi ólöglega búsetu. Skipulags- og byggingarfulltrúi gerði 15.07.2009 eigendum skylt að veita upplýsingar um málið innan tveggja vikna. Bærust þær ekki yrði málinu vísað til skipulags- og byggingarráðs með tillögu um viðeigandi aðgerðir skv. skipulags- og byggingarlögum. Svar hefur ekki borist. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 05.08.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð gerir eigendum skylt að veita upplýsingar um málið innan tveggja vikna.   • 0905019 – Drangahraun 3, complaint

    Athugasemdir bárust vegna Drangahrauns 3. Drangahraun 1b setti inn kvörtun v/fyllingar á húsgrunn. Skipulags- og byggingarfulltrúi óskaði 06.05.2009 eftir upplýsingum frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna. Svar hefur ekki borist. Skipulags- og byggingarfulltrúi ítrekaði 24.06.2009 ósk um upplýsingar frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna. Yrði ekki brugðist við því mundi skipulags- og byggingarfulltrúi vísa málinu til skipulags- og byggingarráðs með tillögu um dagsektir í samræmi við grein 57.1 í skipulags- og byggingarlögum nr 73/1997. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 29.07.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð óskar eftir upplýsingum frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna.     The Planning and Building Committee requests information from the plot holder of Drangahraun 3 regarding the tidying of the plot within two weeks. If a response is not received within this time, the Planning and Building Committee will refer the matter to the Town Council with a recommendation for a fine in accordance with section 57.1 of the Planning and Building Act no. 73/1997.;

  • 0906205 – Kríuás 47, request for final inspection

    Borist hefur tölvupóstur frá Stefáni Hjaltalín f.h. húsfélagsins að Kríuási 47 dags. 10.06.2009, þar sem óskað er eftir að byggingarfulltrúi krefji byggingarstjóra um lokaúttekt á húsinu. Skipulags- og byggingarfulltrúi beindi því 24.06.2009 til byggingarstjóra að sækja um lokaúttekt í samræmi við grein 53.1 í byggingarreglugerð. Yrði ekki brugðist við því innan tveggja vikna mundi skipulags- og byggingarfulltrúi vísa málinu til skipulags- og byggingarráðs með tillögu um aðgerðir í samræmi við grein 57.1 í skipulags- og byggingarlögum. Erindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 29.07.2009, sem vísaði því til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð beinir því til byggingarstjóra að sækja um lokaúttekt í samræmi við grein 53.1 í byggingarreglugerð.     The Planning and Building Committee directs the building controller to apply for a final inspection in accordance with Article 53.1 of the Building Regulations. If this is not addressed within two weeks, the Planning and Building Committee will refer the matter to the Town Council with a recommendation for action in accordance with section 57.1 of the Planning and Building Act.;

  • 0903209 – Hvaleyrarbraut 22, illegal works continuation

    Tekið fyrir að nýju mál varðandi ólöglegar framkvæmdir við húsið og ólöglega búsetu í húsinu. Komið hefur í ljós að ekki hefur verið brugðist við þessu. Skipulags- og byggingarfulltrúi gerir 08.04.2009 tillögu til skipulags- og byggingarráðs að ítrekuð verði samþykkt til nýrra eigenda um að beitt verði dagssektum í samræmi við VI kafla skipulags- og byggingarlaga nr. 73/1997. Skipulags- og byggingarráð beindi því 12.05.2009 til bæjarlögmanns að nýjum eigendum verði tilkynnt þetta og beindi því jafnframt til bæjarstjórnar að ítrekuð yrði samþykkt til nýrra eigenda um að beitt verði dagssektum í samræmi við VI kafla skipulags- og byggingarlaga nr. 73/1997.%0DBæjarstjórn Hafnarfjarðar ítrekaði 19.05.2009 til nýrra eigenda Hvaleyrarbrautar 22 samþykkt sína frá dags. 29.04.2008 að beitt verði dagssektum í samræmi við VI. kafla skipulags- og byggingarlaga nr. 73/1997 vegna ólöglegra framkvæmda við húsið og ólöglegrar búsetu. Bæjarstjórn gaf núverandi eigendum tvær vikur til að tjá sig um málið eða gera við það athugasemdir. Ekki hafa borist svör við erindinu. Lagt fram bréf slökkviliðsstjóra höfuðborgarsvæðisins til Hófsness ehf dags. 22.07.2009 varðandi lokun hússins vegna ágalla á eldvörnum.

    The Planning and Building Committee makes the following recommendation to the Town Council: “The Town Council of Hafnarfjörður approves that previously imposed daily fines for illegal works and occupation of the house, kr. Kr. 50,000 per day, will be collected from the new owners from 1 September 2009, provided that occupation has not been completed by that date and the correct test drawings have been submitted to the building control officer.“;

  • 0906048 – Skipalón 23, site finishing

    An email has been received from residents of Skipalón 25, dated. 26.05.2009, in which residents of Skipalón 25 complain about the state of the building site at Skipalón 23. On 10.06.2009, the planning and building officer required the developer to tidy the site so that it poses no danger or inconvenience to neighbours. If this was not rectified within two weeks, the planning and building officer would make a proposal to the planning and building committee for the imposition of a fine in accordance with Article 57 of the Planning and Building Act No. 37/1997. The Planning and Building Officer referred the matter to the Planning and Building Committee on 1 July 2009. On 7 July 2009, the Planning and Building Committee required the builder to secure the building site so that it does not pose a danger or cause a nuisance to neighbours. If this was not rectified within two weeks, the Planning and Building Committee would make a proposal to the Town Council for the imposition of a fine in accordance with Article 57 of the Planning and Building Act No. 37/1997. Information on the rightful owners of the house was presented.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves that previously announced daily fines for the condition of the site will be kr. 20,000 per day, to be collected from 1 September 2009, if the necessary improvements have not been made by that date.“

  • 0903168 – Reykjavíkurvegur 50, Krónan, site maintenance

    A letter from the residents' association at Reykjavikurvegur 50 is to be reconsidered, in which a complaint is made regarding the containers of the Krónan store, which are a significant eyesore and a nuisance to the residents of the building. On 10 June 2009, the Planning and Building Officer required the owners of the containers to arrange for them to be positioned so as not to cause a nuisance or inconvenience to neighbours. If this is not rectified within two weeks, the Planning and Building Officer will make a proposal to the Planning and Building Committee for the imposition of a fine in accordance with section 57 of the Planning and Building Act No. 37/1997. The Planning and Building Officer referred the matter to the Planning and Building Committee on 1 July 2009. On 7 July 2009, the Planning and Building Committee required the owners of the containers to arrange for them to be sited so as not to cause an eyesore or inconvenience for neighbours. If this was not rectified within two weeks, the Planning and Building Committee would make a proposal to the Town Council for the imposition of a fine in accordance with section 57 of the Planning and Building Act no. 37/1997.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves that previously announced daily fines for the condition of the plot will be kr. 20,000 per day, and will be collected from 1 September 2009, if the necessary improvements have not been made by that time.“

  • 0706392 – Hjallahraun 2, containers on the plot

    On the plot of land at Hjallahraun 2, there are work sheds and containers owned by Garðafell ehf which do not have a temporary siting permit. A complaint has been received from Reykjavikurvegur 60 regarding the containers, which are said to be partly on their plot of land. On 20/05/2009, the Planning and Building Officer required the owners of the containers to either remove them within two weeks or apply for a temporary siting permit, providing details of their intended location. If they were not removed, the matter would be referred to the Planning and Building Committee with a proposal for appropriate action in accordance with the Planning and Building Act. The request has not been responded to. The Planning and Building Officer referred the matter to the Planning and Building Committee on 01.07.2009. On 07.07.2009, the Planning and Building Committee required the owners of the containers to remove them within two weeks or to apply for a temporary siting permit, providing details of their intended location, within the same period. If the request was not complied with, the matter would be referred to the town council with a proposal for a fine in accordance with section 57 of the Planning and Building Act no. 73/1997.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves that the previously announced daily fines for the condition of the site will be kr. 20,000 per day, to be collected from 1 September 2009, if the containers have not been removed by that time.“

  • 0810289 – Skútahraun 11, fenced plot.

    To consider the letter from Rúnu S. Geirsdóttir, solicitor, dated. 23.07.2009 from the owners of Skútahraun 11, requesting a reasoned justification for the town council's decision to revoke the building permit for a fence between the plots of Skútahraun 11 and Skútahraun 9a, and also requests that the building permit remain in effect. A response letter from the Head of Department, dated 07.08.2009, has been submitted and sent to the letter writer.

    With reference to the justification of the Director of the Department, the Planning and Building Board does not agree to the request for the building permit to remain valid.;
