General presentations

• SB040377 – Minutes of the Planning and Building Officer

  Minutes from the planning and building officer's disposal meetings of 02.12.2009 and 09.12.2009 were presented.

  Part A of the minutes is submitted to the town council for approval.;

• 0904195 – Municipal general plan, water protection area

  A letter from the Energy Authority dated 22 April 2009 was presented.

  The Planning and Building Committee requests the opinion of the Hafnarfjörður Waterworks on the matter.;

• 0905031 – Gunnarssund 9, zoning plan amendment

  The proposal from Ark ehf for a change to the detailed plan for the city centre site, according to the drawing by Jon Nordsteien dated 06.05.2009, is reconsidered. The application has been subject to local consultation in accordance with section 2 of Article 26 of the Planning and Building Act No. 73/1997. Objections were received. The detailed plan was approved by the Planning and Building Committee on 07.07.2009, but was annulled by the Planning and Building Appeals Board due to a procedural defect in its public consultation. The Planning and Building Board approved on 20 October 2009 to advertise the proposal in accordance with the first paragraph of Article 26 of the Planning and Building Act. The period for public consultation was from 22 October 2009 to 20 November 2009, and the deadline for comments was 7 December 2009. One comment was received. A public meeting regarding the draft detailed plan was held on 23 November 2009. The matter was considered at the planning and building officer's meeting on 09.12.2009, which referred it to the Planning and Building Committee. A summary by the Planning and Building Department of the comments received was presented, along with draft responses.

  The Planning and Building Committee endorses the report of the Planning and Building Department, approves the detailed plan, and resolves that the matter be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the City Council:

  “The City Council of Hafnarfjörður approves an amendment to the 1981 detailed plan for the city centre regarding the plot Gunnarssund 9, dated. 16.10.2009, amended 9.12.2009, and that the matter be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997.“;

• 0912050 – 10 Lækjargata, zoning plan amendment.

  Hafliði Richard Jónsson is applying for permission to amend the detailed plan for 10 Lækjargata. According to drawings by Hilmar Þór Björnsson, dated. 03.12.09. The application was considered at the planning and building officer's meeting on 09.12.2009, which referred it to the planning and building committee.

  The Planning and Building Committee agrees that the zoning plan amendment will be advertised in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997, as amended.;

• 0911150 – Austurgata 22, enquiry

  To reconsider the new application from Mats ehf of 05.11.2009, requesting to build a new house at 22 Austurgata, in accordance with drawings by Kári Eiríksson dated 10.07.2007. Postponed at meeting 238.

  The Planning and Building Committee welcomes the application and requests that the applicant develop the proposal further in collaboration with the Planning and Building Department.;

• 0812152 – Selvogsgata 1, building permit

  A letter from Bjögvin Þórðarson of the Lex law firm, on behalf of the residents of Brekkugata 26, was presented. 24.11.2009, where an objection is raised to the works at Selvogsgata 1, where concrete is being poured for windows in the basement flat of Brekkugata 1. An objection is raised to the documents that accompanied the local notice. The Planning and Building Committee approved on 1 December 2009 that an opinion be sought from the Planning Authority regarding the neighbourhood notification, and required the owner of Selvogsgata 1 to partially halt the works until that opinion was available. A letter from the Planning Authority, dated 8 December 2009, was presented, stating that the building permit had not been properly approved.

  The Planning and Building Committee directs the owner of Selvogsgata 1 to temporarily halt the ongoing works on the wall at Brekkugata 26, due to the opinion of the Planning Office, and instructs the planningand Building Department to discuss the matter with the parties and present the outcome.;

• SB040347 – Environment Committee/Agenda 21

  The minutes of the Environment Committee/Local Agenda 21 meeting of 09.12.2009 were presented.

• 0911017 – Kaldárselsvegur 207-6643, summer house

  Thorgerd Elísa Mortensen submits a query dated 30.10.2009 regarding the proposed extension and renovation of a summer house on her plot at Kaldárselsveg. The Planning and Building Department outlines the existing agreements concerning the plot. Postponed at the 238th meeting. Elsa Jónsdóttir and Berglind Guðmundsdóttir presented the facilities in the area.

  The Planning and Building Committee postpones taking a position on the query.;

• 0711020 – Uppland, Hafnarfjörður, outline plan.

  The proposal from Landslags ehf for a framework plan for the hinterland of Hafnarfjörður, dated 14 February 2008, was reconsidered. Previously, a proposal for the introduction and notes from the Planning and Building Department, from meetings with interest groups on 11 and 20 November 2008, had been presented. Drafts of the framework plan were presented at a meeting of the Planning and Building Committee on 24th March 2009. At its meeting on 29th June 2009, the Planning and Building Committee referred the matter for presentation to the Environment Committee/Local Agenda 21, the Executive Committee, Family Council and the Town Council.

  Submitted. The Planning and Building Committee instructs the Planning and Building Department to proceed with the project, including the preparation of a report and the finalisation of the drawings.;

• 0911585 – Regional Plan for the Capital Region 2001-2024, Mosfellsbær

  A letter from Mayor Haraldur Sverrisson, dated 24 November 2009, was presented, along with a proposal for a minor amendment to the Regional Plan for the Capital Area 2001–2024, to expand the industrial area at Tungumelar. Comments are requested by 24 December 2009. A proposal for a report from the Directorate, dated 11 December 2009, was presented.

  The Planning and Building Committee endorses the director's report.;

• 0903127 – The town boundary between Hafnarfjörður and Garðabær at Hrafnista

  The proposal for a change to the municipal boundaries between Hafnarfjörður and Garðabær, concerning the new Hrafnista building and other minor changes, was reconsidered. The Director of the Department previously reported on discussions with the Planning Manager of Garðabær regarding the change. A map from the Planning and Building Department showing the potential change at Hrafnista was previously submitted. Previously submitted was an email from Arinbjörn Vilhjálmsson, Planning Officer for Garðabær, dated 26.11.2009, regarding the Garðabær Town Council's handling of the matter.

  The Planning and Building Committee agrees with this conclusion and makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council agrees to the proposal for changes to the municipal boundaries between Hafnarfjörður and Garðabær as shown on the drawing prepared by the Department of Planning and Building.“;

• 0802184 – Strandgata 57, Viking Hotel, test drawings

  Fjörukráin ehf submitted test drawings on 26.02.08 with the approval of the fire service. Drawings designed by Jón Þór Þorvaldsson, dated. 14.03.06. The Planning and Building Officer deferred the application on 10.06.2009 as the submitted documents were insufficient. On 02.09.2009, the Planning and Building Officer required the owner to submit them. If this was not done within four weeks, the Planning and Building Officer would make a recommendation to the Planning and Building Committee for the imposition of a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997. The matter was considered at a service meeting of the Town Planner on 28 October 2009, who referred it to the Planning and Building Committee with the following recommendation: „As the approved drawings have not yet been submitted, the Planning and Building Committee requires the owner to submit them. Should this not be done within four weeks, the Planning and Building Committee will make a proposal to the Town Council for the imposition of a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“

  The Planning and Building Committee agrees as follows: “As the approved drawings are not yet available, the Planning and Building Committee requires the owner to submit them. If this is not done within four weeks, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“;

• 0912103 – Study trip

  Staff from the Planning and Building Department presented a study trip to Finland in October 2009 to examine planning and architecture. The trip was paid for by the participants, with a grant from the Hafnarfjörður Staff Association. Málfríður, Anna Sofía, Hrólfur and Sigríður, employees of the Planning and Building Department, gave a report on the trip.

• 0905019 – Drangahraun 3, complaint

  Athugasemdir bárust vegna Drangahrauns 3. Drangahraun 1b setti inn kvörtun vegna fyllingar á húsgrunn. Skipulags- og byggingarfulltrúi óskaði 06.05.2009 eftir upplýsingum frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna. Svar barst ekki. Skipulags- og byggingarfulltrúi ítrekaði 24.06.2009 ósk um upplýsingar frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna. Skipulags- og byggingarráð óskaði 25.08.2009 eftir upplýsingum frá lóðarhafa Drangahrauns 3 varðandi frágang lóðarinnar innan tveggja vikna. Bærist ekki svar innan þess tíma mundi skipulags- og byggingarráð vísa málinu til bæjarstjórnar með tillögu um dagsektir í samræmi við grein 57.1 í skipulags- og byggingarlögum nr 73/1997. Lóðarhafi gerði 26.08.2009 grein fyrir áformum um frágang lóðarinnar í samráði við byggingarfulltrúa, sem frestaði frekari aðgerðum að sinni. Eigandi Drangahrauns 1 mætti í viðtal 11.11.2009 og kvartaði yfir að ekkert hefði gerst í málinu.%0DSkipulags- og byggingarfulltrúi gerði 11.11.2009 eiganda Drangahrauns 3 skylt að ganga frá lóðarmörkum að Drangahrauni 1 í samræmi við þær hugmyndir sem hann gerði grein fyrir á fundi með skipulags- og byggingarfulltrúa, gera fláa á sinni lóð eða steypa vegg á lóðarmörkunum. Yrði ekki brugðist við þessu innan tveggja vikna mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta í samræmi við 57. grein skipulags- og byggingarlaga nr. 73/1997. %0DErindið var til umfjöllunar á afgreiðslufundi skipulags- og byggingarfulltrúa 09.12.2009, sem bókaði eftirfarandi: Þar sem frágangur lóðarinnar snertir mál Drangahrauns 1, sem krefst skjótrar afgreiðslu, vísar skipulags- og byggingarfulltrúi málinu til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð samþykkir að umrædd fylling á lóðarmörkum verði unnin á vegum bæjarins og á kostnað eiganda Drangahrauns 3 í samræmi við 2. mgr. 57. greinar skipulags- og byggingarlaga nr. 73/1997: „Byggingarnefnd getur látið vinna verk, sem hún hefur lagt fyrir að unnið skyldi, á kostnað þess sem vanrækt hefur að vinna verkið.“ Eigandi Drangahrauns 3 hefur tvær vikur til að ganga frá málinu með öðrum hætti og andmælarétt til sama tíma.“%0D

  The Planning and Building Committee agrees that the aforementioned infill at the plot boundaries will be carried out by the municipality and at the expense of the owner of Drangahraun 3, in accordance with section 2. para. 57 of the Planning and Building Act no. 73/1997: “The Building Control Authority may have work, which it has ordered to be carried out, done at the expense of the person who has neglected to do the work.„ The owner of Drangahraun 3 has two weeks to resolve the matter by other means and has the right to object until the same time.“;
