    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's disposal meetings of 03.02.2010 and 10.02.2010 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 09102693 – Ölduslóð 12, enquiry

      The query from Gísli G. Gunnarsson, building surveyor, on behalf of the owners of the house at Ölduslóð 12 regarding the raising of the house's roof was reconsidered. The Planning and Building Committee rejected the query as it was submitted. New drawings by Gísli Gunnarsson, dated 21/01/2010, were submitted. The matter was discussed at the disposals meeting of the Planning and Building Officer on 03/02/2010, who referred it to the Planning and Building Committee.

      The Planning and Building Committee refers to the previous decision of 3 November 2009 and instructs the Planning and Building Department to review the query more thoroughly.;

    • 0912050 – 10 Lækjargata, zoning plan amendment.

      Hafliði Richard Jónsson is applying for permission to amend the detailed plan for 10 Lækjargata. According to drawings by Hilmar Þór Björnsson, dated. 03.12.09. The Planning and Building Committee approved on 15.12.2009 that the zoning plan amendment would be advertised in accordance with the 1st paragraph of Article 26 of the Planning and Building Act No. 73/1997, as amended. The amendment to the detailed plan was advertised on 25.12.2009 and the period for comments closed on 09.02.2010. A comment was received. The application was considered at a meeting of the Planning and Building Officer on 10 February 2010, who referred it to the Planning and Building Committee.

      The Planning and Building Committee instructs the Planning and Building Department to propose a response to the submitted comment.;

    • 1001060 – Miðholt 1-3-5, change to the local plan

      Búseti is applying for a proposal for a revised local plan for the construction of a car park, in accordance with a drawing by Gunnar Sigurðsson dated 05.01.2010. The proposal was subject to local consultation on 08.01.2010, and the deadline for comments was 08.02.2010. A comment was received. The application was considered at the disposal meeting of the Planning and Building Officer on 10 February 2010, which referred it to the Planning and Building Committee.

      The Planning and Building Council instructs the Planning and Building Department to propose a response to the submitted comment.;

    • 0812152 – Selvogsgata 1, building permit

      Tekið fyrir að nýju erindi Bjögvins Þórðarsonar Lex lögmannsstofu f.h. íbúa að Brekkugötu 26 dags. 24.11.2009, þar sem gerð er athugasemd við framkvæmdir við Selvogsgötu 1, þar sem steypt er fyrir glugga í kjallaraíbúð Brekkugötu 1. Gerð er athugasemd við þau gögn sem fylgdu grenndarkynningunni. Skipulags- og byggingarráð samþykkti 01.12.2009 að leita álits Skipulagsstofnunar varðandi grenndarkynninguna og gerði eiganda Selvogsgötu 1 skylt að stöðva framkvæmdir að hluta þar til það álit lægi fyrir. Í svarbréfi Skipulagsstofnunar dags. 8.12.2009 kemur fram að ekki hafi verið staðið rétt að samþykkt byggingarleyfisins. Skipulags- og byggingarráð gerði 15.12.2009 eiganda Selvogsgötu 1 skylt að stöðva áfram tímabundið framkvæmdir við vegginn að Brekkugötu 26 vegna álits Skipulagsstofnunar og fól skipulags- og byggingarsviði að ræða við aðila og kynna niðurstöðuna. Sviðsstjóri og skrifstofustjóri/lögmaður skipulags- og byggingarsviðs gera grein fyrir viðræðum við málsaðila. Lagt fram bréf Bjögvins Þórðarsonar Lex lögmannsstofu f.h. íbúa að Brekkugötu 26 dags. 09.02.2010, þar sem m.a. er farið fram á að byggingarleyfið verði fellt úr gildi.%0D

      The working group on the citizens' assembly presented the timing and implementation of the assembly. The meeting was attended by the working group's representative, Steinunn Þorsteinsdóttir, as well as the chair, Gísli Valdimarsson, and Berglind Guðmundsdóttir, who are regular attendees of the planning and building committee's meetings.

    • 1001277 – Strandgata 19, enquiry

      To discuss an enquiry from Skák ehf dated 28.01.10, which requests an extension to the rear building/annex, in accordance with drawings by Kári Eiríksson dated 15.01.2010.

      The Planning and Building Committee considers the scale of the development to be too great and is opposed to the application as it stands.;

    • 0907153 – Hverfisgata-Mjósund-Austurgata-Gunnarssund zoning plan

      Draft outline plan by the Department of Planning and Building for a site bounded by Mjósund, Austurgata, Gunnarssund and the upper boundaries of the plots of houses at Hverfisgata 31-49, was discussed.

    • SB050584 – Reykjanesbraut, detailed plan

      Baldvin Einarsson, a representative of the engineering firm Efla, attended the meeting and presented the preliminary design for the project, together with Thráinn Hauksson of Landslagi ehf.

    • 0912139 – Reykjanesbraut, junction with Straumsvík

      A resolution from the Isal Staff Trust Board was presented regarding traffic safety issues at the entrance from the Reykjanesbraut onto the aluminium smelter's site. A proposal from the Road Administration for underpasses was presented.

      Submitted. The Planning and Building Committee agrees that traffic safety must be improved at the junction of the Reykjanesbraut and the entrance to the aluminium smelter site.;

    • 10022435 – Reykjanesbraut, working group on Suðurbraut

      The Chair and Helga Stefánsdóttir, Executive Director, presented the work of the group. Also, Guðbjörg Lilja Erlendsdóttir from Eflu.

    • 1001040 – Tjarnarvellir 2, change to the local plan

      On 5 January 2010, Manning Ltd. applied for permission to amend the detailed plan for Tjarnarvellir 2, in accordance with a drawing by arkitektur.is. The application was subject to local consultation on 11 January 2010. The comment period ended on 8 February 2010. One comment was received. The application was considered at the planning and building officer's meeting on 10 February 2010, which referred it to the Planning and Building Committee.

    • 10021380 – Erluás 82, building permit, conservatory

      On 04.02.10, Helgi Einarsson submitted an application for permission to build a conservatory to his house, in accordance with drawings by Sigurður Þorvarðsson dated 02.05.2001. The application was considered at the planning and building officer's meeting on 10 February 2010, which referred it to the planning and building committee.

      The Planning and Building Committee advises the landowner that he is permitted to proceed with an amendment to the detailed plan at his own expense, in accordance with section 1 of Article 23 of the Planning and Building Act No. 73/1997.

  • 0805264 – Skógarás H/7, comment

    The landowner's objection to the permit granted to raise the house at Skógarási E/6 is reconsidered. A survey by the Planning and Building Department of decisions in Ásland, dated 27.06.2008, was previously presented. The Planning and Building Committee instructed the Planning and Building Department to investigate possible measures to rectify the matter in accordance with the Planning and Building Act and regulations. Previously submitted letter from Björn R. Ingólfsson and Sigríður B. Guðmundsdóttir, Skógarási 7, dated 07.01.09. On 14.01.2009, the planning and building officer reiterated the request for clarification from the property owners. Previously submitted letter from Lúther Sigurðsson and Ingibjörg Ragnarsdóttir, dated 20.12.2007. Previously submitted updated summary from the department head, dated 28.04.2009, along with sections showing the building's elevations. The Planning and Building Committee required the owners, on 12 May 2009, to bring the house into compliance with the approved drawings. A complaint from residents of the street, dated 2 November 2009, has been received. A revised summary by the department manager of the case proceedings, dated February 2010, a summary by the department manager of the facts of the case, dated February 2010, was presented, along with the most recently approved drawings.

    The Planning and Building Committee instructs the Head of Department to notify the owners of Skógarás E/6 of the Committee's decision of 12 May 2009.;

  • 10021774 – KFUM and K in Kaldársel, Summer Camp Rebuilding

    The board of the KFUM and K summer camp at Kaldársel, by letter dated 02.02.2010, requests an opinion from the Department of Planning and Building or the Planning and Building Council on the reconstruction of part of the summer camp at Kaldársel, which was damaged in a storm. The matter was discussed at the planning and building officer's disposal meeting on 10.02.2010, which referred it to the Planning and Building Committee. Minutes from the meeting with representatives of KFUM and K were presented.

    The Planning and Building Committee welcomes the proposal and instructs the Planning and Building Department to proceed with it in consultation with the management of the summer camp.;

  • 10022261 – Sign on farmland

    A regulation concerning signs within the jurisdiction of Akureyri, from 1 October 1993, was presented. The matter was discussed at the disposals meeting of the Planning and Building Officer on 10 February 2010, which referred it to the Planning and Building Committee with a proposal that a similar by-law be drawn up for the Borough of Hafnarfjörður.

    The Planning and Building Council instructs the Planning and Building Department to prepare a draft by-law on signage within the jurisdiction of Hafnarfjörður.;

  • 0702005 – Master Plan of Hafnarfjörður, power lines and substations.

    A proposal from the Planning and Building Department for an amendment to the 2005 Master Plan for Hafnarfjörður is reconsidered. – 2025 with regard to the electricity transmission system, in order to align with Landsnet's plans for strengthening the electricity transmission system in Southwest Iceland and the agreement between Hafnarfjörður and Landsnet on the matter, which was approved by the town council on 11 November 2008. The changes concern power lines and underground cables from Geitháls and Sandskeiði to the existing and planned substations in Hafnarfjörður and from there onwards to the aluminium smelter in Straumsvík and to the South-West (Suðurnesir). The town council approved the proposal for publication, together with the engineering firm Efla, dated. 18.10.2009. A preliminary information meeting was held on 07.09.2009. Previously submitted were the opinion of the Planning Authority on the preliminary assessment report dated 17.09.2009 and the final assessment report by Efla and Landsnet dated 10.08.2009. The letter from the Planning Authority dated 18.11.2009 regarding the proposal's notification was reconsidered, and the Planning and Building Council instructed the Planning and Building Department to respond to the comments raised therein. Previously submitted reviews from the National Monuments Authority and the Health Surveillance Authority for the Hafnarfjörður and Kópavogur area, along with a revised planning map dated 01.02.2010 and a revised environmental report dated 16 October 2009.

  • 0707015 – Master Plan of Hafnarfjörður 2005-2025 Krýsuvík, request for amendment

    The proposal from the Planning and Building Department for an amendment to the Master Plan of Hafnarfjörður 2005–2025, Krýsuvík, concerning the location of a test borehole, revised drawing dated 22.09.2009, was reconsidered. The proposal was advertised on 21 December 2009 in accordance with Article 18 of the Planning and Building Act No. 73/1997, and the consultation period was until 9 February 2010. No comments were received except from the following consultees: the Environmental Agency, dated 28 January 2010, and the Board of Reykjanes Nature Reserve, dated 8 February 2010.

    The Planning and Building Council instructs the Planning and Building Department to compile responses to the comments.;

  • 0811157 – Titan Global ehf, plot for a data centre

    The Director of Services reports on discussions with representatives of Titan Global ehf on 09.02.2010. A draft memorandum of understanding between Titan Global ehf and the City of Hafnarfjörður is presented.

  • 0910333 – Arnahraun 21, flat 0101, illegal occupation

    Information has been received of an illegal occupation of a storage room in the communal area of Arnarhraun 21, which also fails to comply with the provisions of the building regulations. On 07.10.2009, the Building Control Officer required the owner of the storage unit to vacate the premises within four weeks and to remove all alterations carried out without a building permit. The Planning and Building Officer referred the matter to the Planning and Building Committee, which on 1 December 2009 required the owner of the storage unit to complete their occupation of the premises within four weeks and to remove all alterations carried out without a building permit. Failure to comply within this timeframe would result in the Planning and Building Committee referring the matter to the Town Council with a recommendation for a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.

    The Planning and Building Committee makes the following recommendation to the City Council: “The City Council of Hafnarfjörður approves that daily fines of kr. 50,000 per day shall be imposed on the owner of Arnarhraun 21, flat 0101, from 15 March 2010, if the occupation is not completed by that date and the unauthorised alterations have not been removed.“;

  • 0912137 – Firework sale, sign

    Emil Hreiðar Björnsson, on behalf of Alvöru Gæða ehf, applied to erect advertising signs for a firework sale. The Planning and Building Officer approved the application on 16.12.2009 on the condition that the signs would be taken down after the 13th, and that they would not obstruct traffic. Despite repeated requests, the sign at Reykjavikurveg has not been removed. The matter was discussed at a service meeting of the Planning and Building Officer on 10 February 2010, which referred it to the Planning and Building Committee with a recommendation that the sign be removed at the owners' expense if the request is not complied with within one week.

    The Planning and Building Committee agrees that the said sign will be removed at the owners' expense if the request is not addressed within one week.;

  • 0910988 – Burknavellir 1 A,B,C, final inspection

    The matter of the letter from the residents“ association at Burknavöllar 1 A, B and C, dated 03.10.2009, is reconsidered, in which it was requested that the planning and building officer make it mandatory for the building manager to apply for a final inspection of the building on 07.10.2009. The Planning and Building Officer made it mandatory for the building surveyor on 01/12/2010 to apply for a final inspection within four weeks, in accordance with section 53.1 of the Building Regulations. Failure to comply would result in the Planning and Building Officer referring the matter to the Planning and Building Committee with a recommendation for a daily fine, in accordance with section 57 of the Planning and Building Act No. 73/1997. The Planning and Building Officer referred the matter to the Planning and Building Committee, which on 1 December 2009 required the building supervisor to apply for a final inspection of the building within four weeks, in accordance with section 53.1 of the Building Regulations. Should this not be addressed, the Planning and Building Committee will refer the matter to the Town Council with a proposal for a daily fine in accordance with Article 57 of the Planning and Building Act No. 73/1997." A letter from the building manager dated 14.12.2009 and notes from a conversation with the chairman of the residents' association dated 21.01.2010 were presented.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council resolves that the previously announced daily fines against the building supervisor of the house shall be kr. 20,000 per day, and shall be collected from and including 15 March 2010, if the request has not been addressed by that time.“

  • 0804310 – Miðvangur 41, flat 205, alterations

    Comments have been received from the board of the residents' association, Miðvangur 41, dated 22.04.2008, stating that illegal works are underway in flat 205. A site inspection has revealed that alterations are being carried out without the required permit. On 14.05.2008, the flat owner was ordered to immediately cease the works in accordance with section 56 of the Planning and Building Act. According to information received, an opening has been created between the living room and the balcony, and the flat is being renovated. On 06.05.2009, the planning and building officer requested drawings showing the aforementioned works, in particular whether the building's load-bearing structure had been altered. No response was received. On 11 August 2009, the Planning and Building Committee required the flat owner to submit drawings of the alterations within 4 weeks. If this was not complied with, the Planning and Building Committee would recommend to the town council that a daily fine be imposed in accordance with section 57 of the Planning and Building Act no. 73/1997. No action was taken, and on 1 December 2009 the Planning and Building Committee made a proposal to the Town Council that a fine be imposed from 1 January 2010 if the request was not complied with. Memorandum of a conversation with the son of the new owner of the flat, 09.12.2010, was submitted.

    The Planning and Building Committee gives the owner of the flat until 15 March to submit a statement on the matter in accordance with the aforementioned conversation.;
