    • SB060161 – Helluhraun 2

Numerous complaints have been received regarding the state of the grounds at Helluhraun 2. The property owners have been repeatedly advised to remove unauthorised containers from the site and have been given the opportunity to comment on the matter. The Planning and Building Officer made a recommendation to the Planning and Building Committee that a fine be imposed if the containers are not removed. The property owners were given until 30th April to comment on the matter. A letter was received from the plot holder on 29/04/2008, in which they promised to bring the plot into a satisfactory condition. Nothing has been done on the matter, and the plot is one of the eight worst-looking in the neighbourhood. On 21.04.2010, the planning and building officer required the property owner to improve the appearance of the plot within four weeks. Should this fail to be addressed, the Planning and Building Officer would refer the matter to the Planning and Building Committee with a recommendation for a daily fine, in accordance with section 68.6 of the Building Regulations and section 57 of the Planning and Building Act No. 73/1997. The request has not been responded to. On 22 June 2010, the Planning and Building Committee required the property owner to improve the landscaping of the plot within four weeks. Failure to respond would result in the Planning and Building Committee referring the matter to the Town Council with a proposal for a daily fine, in accordance with section 68.6 of the Building Regulations and section 57 of the Planning and Building Act No. 73/1997. No action has yet been taken on the matter.

The owners of Breiðvangur 65 complain about a fence around Breiðvangur 63, which reaches full height right up to their property boundary. They also state that the owner of Breiðvangur 63 intends to erect a fence between the plots without their consent. By letter dated 4 August 2010, Jón Holbergsson and Sigurborg Pétursdóttir request that the matter be reconsidered. On 24 August 2010, the Planning and Building Committee ruled that the fence around Breiðvang 63 was unauthorised, and that the owner must either apply for permission for it or remove it otherwise. The application must be accompanied by written consent from the landowners of the plots to which the fence adjoins. The Planning and Building Committee gave the landowner of Breiðvang 63 four weeks to respond to the matter. A reminder has been received from the owners of Breiðvangur 65. On 19/10/10, the Planning and Building Board reiterated its previous instructions to the owners of Breiðvangur 63. The owner of Breiðvangur 65 attended an interview, and a report from the supervisor of the planning and building department on the location and height of the fences is on file. The fences have the written consent of the owners of Breiðvangur 61 and Norðurvangur 8.

Following further discussion of the matter, the planning and building officer reiterates that this is a communal plot of land and the residents are required to establish a residents' association in accordance with the Law on Multi-Property Buildings, Article 13. The residents' association is required to address the matter and apply for planning permission for fencing on the plot, in accordance with the resolutions of the Planning and Building Committee. If the request is not addressed within 4 weeks, the Planning and Building Officer will refer the matter to the department's solicitor to determine the appropriate enforcement action.
