  1. Part A of building permits

    • 1210560 – Bjarkavellir 1A, building permit

      On 26 October 2012, Valhús ehf applied to build a 21-unit block of flats in accordance with drawings by Sigurður Þorvarðarson dated 26 October 2012.

      The Planning and Building Officer approves the building plans in accordance with Article 11 of the Building Regulations Act no. 160/2010. A site plan must be submitted before any further buildings on the plot are approved. A building permit will be issued once the conditions of clauses 1-4 of Article 13 of the Building Regulations have been met. Article 13. Issuance of a building permit. Conditions for the issuance of a building permit are as follows: 1. The structure and its use are in accordance with the area's planning schemes.$line$ 2. The main and specialist drawings have been reviewed and the granting authority has endorsed them to confirm approval.$line$ 3. Building permit fees and other required charges have been paid, such as the road construction fee in accordance with the provisions of the Act on Road Construction Charges and the parking fee or fee for planning work in accordance with the provisions of the Planning Act, or an agreement has been reached on their payment. However, fees that are not due for payment until the building permit is issued are excluded.$line$ 4. The building supervisor has signed a declaration of their responsibility and has submitted to the licensing authority the signed declarations of responsibility of the tradesmen who will be responsible for individual parts of the work.

    • 1211154 – Móabarð 12b extension

      On 13 November 2012, Eiríkur Skarphéðinsson applied for permission to build an extension on the south-west side of a detached house to house a dining room, in accordance with drawings by Kári Eiríksson dated 6 November 2012.

      The Planning and Building Officer approves the building plans in accordance with Article 11 of the Building Regulations Act no. 160/2010. A building permit will be issued once the conditions of paragraphs 1-4 of Article 13 of the Building Regulations Act have been fulfilled. Article 13. Issuance of a building permit.     • 1211157 – Gjáhella 11, application for a building permit

      Permission is sought for internal alterations to previously approved plans. In place of the former arrangement, the building will be converted into a single operational unit. Light industrial use will occupy the ground floor, with offices and staff facilities on the first floor. The external appearance of the building will remain unchanged.

      The Planning and Building Officer approves the application in accordance with Article 11 of the Buildings Act no. 160/2010.

    • 1211151 – Berjahlíð 1. question

      On 13 November 2012, Mihajlo Velemir submitted an enquiry regarding the installation of a satellite dish on the east side of the block of flats at Berjahlíð 1. A neighbour's consent and a sketch showing the dish's location are attached.

      The Planning and Building Officer approves the application in accordance with Article 11 of the Buildings Act no. 160/2010.

    • 1211221 – Sorlaskeið 24. Stables

      On 19 November 2012, Sigurður T. Sigurðsson applied for permission to widen the door on the north-east side of the stable by 150 cm, in accordance with drawings dated 12 November 2012.

      The Planning and Building Officer approves the application in accordance with Article 11 of the Buildings Act no. 160/2010.

    • 1211264 – Krýsuvík, Seltún installation of a gas meter.

      Baldur Bergsson requests by email on 15 November 2012 that a gas meter be installed in the geothermal area at Seltún in accordance with the attached images. The project relates to gas measurements at the Icelandic Meteorological Office and contributes to research in volcanic monitoring in Iceland.

      The Planning and Building Officer approves the application but points out that the area is within the Reykjanes Nature Reserve and that the utmost care must therefore be taken when installing these instruments. As Seltúnið is in an active geothermal and fissure area, the City of Hafnarfjörður will not bear any costs for any potential damage to the equipment.

    Part B: Organisational Matters

    • 1210356 – 14 Brekkugata, zoning plan amendment

      On 16/10/12, Ragnar Agnarsson applied for a change to the detailed plan for a plot. The application was subject to local consultation in accordance with section 2 of the Planning Act No. 123/2010. The comment period ended on 19/11/2012. One comment was received.

      The Planning and Building Officer refers the matter to the Planning and Building Committee.

    • 1112190 – Kríuás 17 a and b, final inspection

      The Planning and Building Officer summoned the building supervisor, Jóhann G. Hlöðversson, for a final inspection on 19 March 2012 at 15:00, in accordance with Article 36 of the Construction Act No. 160/2010. The building supervisor was required to take the measures stipulated by law. Should he fail to comply, the planning and building officer would invoke the provisions of Articles 56 and 57 of the same Act regarding daily fines and a reprimand. The request was not complied with. The Planning and Building Officer imposed a fine of kr. 20,000 per day on the building supervisor, Jóhann G. Hlöðversson, from 01.10.2012, in accordance with section 56 of the Building Regulations Act, had he not responded to the request by that date. Furthermore, a request for a reprimand would be sent to the Building Authority in accordance with the same article of the Act. The building supervisor requested an extension until 01.01.13.

      The Planning and Building Officer points out that daily penalties will be levied from 1 January 2013 if an application for the final inspection has not been submitted by then. Furthermore, a request for a reminder to the Building Control Authority.

    • 1210657 – Hólshraun 2, extension

      The owners of the property at Hóslhrauni 2 request the formal revocation of the building permit for an extension to the said house, which was applied for and approved on 18 October 2006. The Planning and Building Officer agreed on 14 November 2012 to revoke the building permit, on the condition that a corrected registration table is submitted, signed on form A2 and in electronic format. It has since been discovered that alterations have been made to the property.

      The Planning and Building Officer further requests working drawings of the house showing the aforementioned alterations, before the building permit can be cancelled.

    • 1003444 – Norðurhella 10, stage of construction and use.

      The building is registered at construction stage 2, inspection of the foundation walls, but it is fully completed and in use. Daily fines were imposed, but an extension was granted until 03.03.11 to complete the inspections. On 28.03.12, the planning and building officer required the building supervisor to apply for a certificate of occupancy within 3 weeks. If this is not done, the planning and building officer will use the provisions of the Buildings Act to enforce remedial action. The owners believe the matter is with the Capital Region Fire and Rescue Service.

      The Planning and Building Officer requests information on the matter from the Capital Region Fire and Rescue Service.

    • 1011245 – Rauðhella 9, stage of construction and use

      At Rauðhellu 9, there are 7 registered properties, all of which are registered in building phase 4, maintenance phase 8, but all are in use. The Planning and Building Officer called for a final inspection on 27 March 2012 in accordance with Article 36 of the Construction Act no. 160/2010. The building supervisor was required to take the measures stipulated by the Act. Should he fail to comply, the Planning and Building Officer would apply the provisions of Articles 56 and 57 of the same Act regarding daily fines and a reprimand. There was no response to the notice. On 09.05.12, the Planning and Building Officer imposed daily fines of kr. 20,000 per day on the building supervisor, Guðmund Ragnar Guðmundsson, from 1 July 2012, in accordance with Article 56 of the Act on Construction, No. 160/2010, if he had not applied for the final inspection by that date. Furthermore, a request would be sent to the Building Authority to issue a reprimand to the building supervisor in accordance with Article 57 of the Act on Civil Engineering Works. It has been established that the building surveyor resigned from the project on 11.04.12, but no status inspection was carried out in accordance with Article 30 of the Building Regulations Act no. 160/2010. The Planning and Building Officer called for a site inspection on 25.06.12 at 13:15. The building supervisor was required to attend the site and take appropriate action in accordance with Article 30 of the Building Regulations Act no. 160/2010. The request was not complied with. The Planning and Building Officer imposed a daily fine of kr. 20,000 on the building supervisor, effective from 01.12.12, and also proposed a reprimand for the building supervisor if the request was not complied with by that date. The building supervisor unilaterally resigned from the project on 11.04.12, but the mandatory site inspection was not carried out.

      The Planning and Building Officer rules that Guðmundur Ragnar Guðmundsson remains the building supervisor for the project and is responsible for the construction works in accordance with the Planning and Building Act No. 73/1997, as a site inspection was not carried out at the time of de-registration. Daily fines will therefore be imposed from 01.12.12. It is possible to refer this matter to the consideration of the Building Inspectorate, in accordance with Article 18 of the Act on Buildings and Construction No. 73/1997.

    • 1111370 – Churchyards 3. Construction stages and use.

      The Planning and Building Officer called for a final inspection on 11 January 2012, in accordance with Article 36 of the Building Regulations No. 160/2010. The building supervisor applied for a final inspection on 20.01.2012, but comments were made regarding the implementation.

      The Planning and Building Officer requests corrected documents so that a final inspection can be carried out.

    • 0709238 – Herjólfsgata 30-34, zoning plan amendment

      The zoning plan amendment approved on 05.09.06 was annulled by the Planning and Building Appeals Board. Subsequent zoning plan amendments for the plot were also annulled.

      The Hleinar to Langeyrarmólar local plan from August 2001 is therefore still in force for the plot.

    • 1011394 – Stapahraun 7-9, stage of construction and use

      Stapahraun 7-9, unit 03 is registered on building permit stage 3, despite the building appearing to be fully constructed and in use; both a certificate of fitness for occupation and a final inspection certificate are missing. On 21.04.10, the building controller required the building supervisor to apply for a certificate of habitability within three weeks, followed by a final inspection. An extension was granted until 15.01.11. On 11.01.12, the planning and building officer required the building supervisor to request an intermediate and final inspection within two weeks. If the request was not complied with, the planning and building officer would use the powers under the Building Regulations Act to secure the necessary improvements. The owner of building unit 03 has declared their share of ownership. The other owners have not responded to the request.

      The Planning and Building Officer will impose a fine on owners if drawings for alterations are not submitted by 15/01/13.

    • 1211201 – Thrastará 36, updated main drawings for final inspection

      Andri Ægisson submits updated principal drawings for the final inspection on 16.11.12, in accordance with the drawings by Gísli G. Gunnarsson of 12.11.12.

      The Planning and Building Officer has deferred the matter as the submitted documents are insufficient. Please see the attached comments.
