      Minutes from the planning and building officer's disposal meetings of 24 June 2009 and 1 July 2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0905031 – Gunnarssund 9, zoning plan amendment

      Arkur ehf is submitting a proposal for an amendment to the detailed plan for the town centre for the plot, according to the drawing by Jon Nordsteien dated 06.05.2009. The proposal has been subject to a local consultation in accordance with paragraph 2 of Article 26 of the Planning and Building Act No. 73/1997. Comments were received. Previously, the Planning and Building Department submitted proposed responses to the comments. Postponed at the last meeting.

      The Planning and Building Committee approves the proposed responses to the comments, approves the planning proposal and that the matter be concluded in accordance with section 26 of the Planning and Building Act No. 73/1997, with three votes. Rósa Guðbjartsdóttir abstains from the vote on the matter.;

    • 0906072 – Breiðvangur 17, alteration of the car park and relocation of a lamppost, building permit.

      On 09.06.09, Ásta Eyjólfsdóttir applies for permission to extend a car park and relocate a lamppost and an electrical box, in accordance with the attached drawing. A report from the Department of Operations is available, which is negative towards the application. The application was discussed at the processing meeting of the Planning and Building Officer on 24 June 2009, which referred it to the Planning and Building Committee.

      The Planning and Building Committee postpones the matter.;

    • 0906175 – Vesturvangur 38, paving and car park

      Lára Huld Grétarsdóttir and Ari Steindórsson are requesting to widen the car park in front of the house in accordance with the attached documents. Permission is also requested to lay a new pavement. The application was considered at the processing meeting of the Planning and Building Officer on 24 June 2009, who referred it to the Planning and Building Committee.

      The Planning and Building Committee postpones the matter.;

    • 0905241 – 33 Hjallabraut, use of roof space, enquiry

      A question dated was submitted. 20.05.2009 from Björn Gústafsson of VSB Engineering on behalf of the residents' association of Hjallabraut 33, regarding the conversion of an unused roof space into 6 flats at the south-east and south-west ends of the building, approx. 360 – 400 m² in total. The application was considered at the processing meeting of the Planning and Building Officer on 24 June 2009, which referred it to the Planning and Building Committee. Gísli Valdimarsson left the meeting during the processing of the matter.

    • 0906157 – Strandgata 9, sun terrace, enquiry

      On 18.06.2009, Súfistinn ehf submitted an enquiry, requesting permission to temporarily install a wooden deck at 9 Strandgata. See attached documents. At its meeting on 23 June 2009, the Planning and Building Committee referred the matter to the Planning and Building Department and the City Centre Committee for their consideration. Submitted are the reports of the Planning and Building Department, dated 26 June 2009, and the City Centre Committee, dated 30 June 2009. Both bodies are in favour of the application.

      The Planning and Building Committee welcomes the application and delegates the processing of the building permit to the Planning and Building Officer.;

    • 0812105 – Kapelluhraun Phase 2: storage area and detailed plan

      A proposal from the Planning and Building Department for the second phase of the industrial estate in Kapelluhrauni, in accordance with the drawing by the Planning and Building Department dated 08.02.2009, was discussed. The plan was advertised on 02.03.2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act, and the period for comments closed on 17.04.2009. Previously submitted comments from Landsvirkjun dated 08.04.2009 and Rio Tinto – Alcan dated 17.04.2009. A summary by the Planning and Building Department of the comments received has been previously submitted. A report from the National Road Administration dated 29 May 2009 was presented. The Planning and Building Department reported on discussions with representatives of Landsvirkjun at the previous meeting. The Planning and Building Department presented its proposal for a response to the comments from the National Road Administration and Rio Tinto – Alcan.

      The Planning and Building Committee endorses the responses of the Planning and Building Department to the comments received, approves the detailed plan and that the matter be concluded in accordance with Article 25 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the City Council:

      “The City Council of Hafnarfjörður approves the detailed plan for Phase 2 of Kapelluhraun, according to the drawing dated. 01.07.2009 and that the matter be finalised in accordance with Article 25 of the Planning and Building Act No. 73/1997.“
      The Planning and Building Committee approves this with three votes to one. Trausti Baldursson abstains from the vote.

  • 0906195 – Eskivellir 11, recreational area

    A letter was submitted from Sólveig Stefánsdóttir on behalf of the residents' association of Eskivellir 9a and b, dated 09.06.2009, requesting that the undeveloped plot at Eskivellir 11 be designated as a protected outdoor recreational area. The matter was considered at the processing meeting of the Planning and Building Officer on 24 June 2009, who referred it to the Planning and Building Committee.

    The Planning and Building Committee denies the application.;

  • 0906191 – Miðholt 1-5, enquiry

    Búseti svf, a housing cooperative, submitted an enquiry on 23.06.2009, requesting permission to amend the detailed plan and provide for 5 carports on the plot. Memorandum from the Department of Operations was presented. The application was considered at the dispositive meeting of the Town Planner on 01/07/2009, who referred it to the Planning and Building Committee.

    The Planning and Building Committee welcomes the question.;

  • 0809375 – Ásvellir, Haukasvæði, amendment to the local plan.

    The proposal by landscape architect Pétur Jónsson, dated 15.02.2009, for a change to the detailed plan for the Haukar sports area at Ásvellir, together with an explanatory drawing, is reconsidered. A new drawing, dated 02.04.2009, has been received. The proposal was advertised on 04.05.2009 in accordance with the 1st paragraph of Article 26 of the Planning and Building Act no. 73/1997. The comment period ended on 16.06.2009. No comments were received.

    The Planning and Building Committee approves the zoning plan amendment and that the matter be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the town council:“The City Council of Hafnarfjörður approves the amendment to the detailed plan for Ásvellir, Haukaskóli area, according to the drawing dated 02.04.2009, and that the matter be concluded in accordance with Article 26 of the Planning and Building Act No. 73/1997.“

  • 0902053 – Hörðuvellir/Reykdalsreitur, Ljósatröð, local plan

    The planning and building department's proposal for a detailed plan for the area at Ljósatröð, dated 15.01.2009, was reconsidered. The area is within the detailed plan for Hörðuvelli – Reykdalsreit, but this part of it was deferred. The detailed plan proposal was advertised from 04.05.2009 to 02.06.2009 in accordance with the first paragraph of Article 26 of the Planning and Building Act no. 73/1997. The deadline for comments expired on 16.06.2009. Comments were received. The application was considered at the planning and building officer's meeting on 24 June 2009, which referred it to the Planning and Building Committee. A proposal from the Planning and Building Department for a response to the comments received was presented.

    The Planning and Building Council instructs the Planning and Building Department to proceed with the matter.;

  • SB050584 – Reykjanesbraut, detailed plan

    Consideration of the proposal by Efla hf and Landslag for the pedestrian link over Reykjanesbraut.

    The Planning and Construction Council discussed ideas for pedestrian crossings over the Reykjanesbraut.;

  • 0707015 – Master Plan of Hafnarfjörður 2005-2025 Krýsuvík, request for amendment

    The decision of the Planning Authority, dated 25 June 2009, that exploratory drilling in Krýsuvík shall not be subject to an environmental impact assessment, is presented.

    The Planning and Building Committee agrees that a proposal be made to amend the Master Plan of Hafnarfjörður 2005 - 2025, Krýsuvík area, for experimental geothermal boreholes. The Planning and Building Department is also tasked with preparing the amendment. The Planning and Building Committee makes the following proposal to the Town Council:“The Hafnarfjörður Town Council approves the preparation of a proposal for an amendment to the Hafnarfjörður 2005-2025 Master Plan, Krýsuvík area, for geothermal heat trial boreholes.“;

  • 0706168 – Tariff schedule, Department of Planning and Building

    A proposal for a new item in the tariff, covering the cost of establishing a plot in accordance with the new Land Registry Act which came into force on 1 January, is under discussion.

    The Planning and Building Committee discussed the proposal.;

  • 0810289 – Skútahraun 11, fenced plot.

    On 27.10.2008, Valfell ehf applied for permission to fence off a plot in accordance with drawings by Svanlaugs Sveinsson dated October 2008. Consent from the landowner of Kalpahraun 16 was received on 03.11.2008, along with that of the owner of Skútahraun 11, northern part. A building permit was approved at the meeting on 25.02.2009. The Planning and Building Officer halted the works on 03.06.2009 as information regarding a right of way between the houses was not available at the time the application was processed. A letter from Smári Úlfarsson, dated 30 June 2009, was presented, in which he, on behalf of Sólbergseignir, requests that the building officer reinstates the plot between properties Skútahraun 9A and 11 to its former state, as stipulated by the easement, as soon as possible. The matter was discussed at a work session of the Planning and Building Officer, who referred it to the Planning and Building Committee.

    The Planning and Building Committee agrees to revoke the building permit for a fence on the plot at Skútahraun 11, which was approved at the processing meeting of the planning and building officer on 25th. 02.2009 and that the plot be restored to its former state. At the time the building permit was processed, there were no information available regarding a servitude on the plot between houses Skútahrauns 11 and Skútahrauns 9A.

    The Planning and Building Committee makes the following recommendation to the Town Council: “The Hafnarfjörður Town Council revokes the building permit for a fence on the plot at Skútahraun 11, which was approved by the town council on 11 March 2009.“;

  • 0904122 – Flatahraun 29 illegal occupation

    It has been brought to light that there is an illegal occupation of the building. An application for a caretaker's flat was refused by the Planning and Building Committee on 23 September 2003 and by the Town Council on 21 October 2004. The Planning and Building Committee refused the change of registration on 24.03.2009, citing Article 4.6.1(2) of the Planning Regulations. On 22 April 2009, the planning and building officer informed the owner that a residential unit is not approved for the building, which is zoned for business use. The unit would therefore be illegal and must be vacated without delay. If this was not done within four weeks, the Planning and Building Officer would make a recommendation to the Planning and Building Committee for the imposition of a fine in accordance with Chapter VI of the Planning and Building Act No. 73/1997. The matter was considered at a work session of the Town Planner on 1 July 2009, which referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee points out that the flat in the building, which is a business area, has not been approved. The flat is therefore illegal and must be vacated without delay. If this is not done within four weeks, the Planning and Building Committee will make a proposal to the Town Council for the imposition of a fine in accordance with Chapter VI of the Planning and Building Act No. 73/1997.“

    The Planning and Building Committee points out that a flat has not been approved in the building, which is a business premises. The flat is therefore illegal and must be vacated without delay. If this is not done within four weeks, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a fine in accordance with Chapter VI of the Planning and Building Act No. 73/1997.;

  • 0706392 – Hjallahraun 2, containers on the plot

    Á lóð Hjallahrauns 2 eru vinnuskúrar og gámar í eigu Garðafells ehf sem ekki hafa stöðuleyfi. Borist hefur kvörtun frá Reykjavíkurvegi 60 vegna gámanna sem sagðir eru vera að hluta til inni á þeirra lóð. Skipulags- og byggingarfulltrúi gerði 20.05.2009 eigendum gámanna skylt að fjarlægja þá innan tveggja vikna eða sækja um stöðuleyfi með upplýsingum um fyrirhugaða staðsetningu þeirra innan tveggja vikna. Bærust þær ekki yrði málinu vísað til skipulags- og byggingarráðs með tillögu um viðeigandi aðgerðir skv. skipulags- og byggingarlögum. Ekki hefur verið brugðist við erindinu. Skipulags- og byggingarfulltrúi vísaði málinu 01.07.2009 til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð gerir eigendum gámanna skylt að fjarlægja þá innan tveggja vikna eða sækja um stöðuleyfi með upplýsingum um fyrirhugaða staðsetningu þeirra innan tveggja vikna. Verði ekki brugðist við erindinu verður málinu vísað til bæjarstjórnar með tillögu um dagsektir skv. 57. grein skipulags- og byggingarlaga nr. 73/1997.“

    The Planning and Building Committee requires the owners of the containers to remove them within two weeks or to apply for a temporary siting permit with details of their intended location within two weeks. If the request is not complied with, the matter will be referred to the Town Council with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.;

  • 0906030 – Glitvellir 37, site finishing

    Borist hefur kvörtun frá íbúum Glitvalla 29 – 43 með tölvupósti dags. 03.06.2009 vegna frágangs á byggingarsvæði Glitvalla 37, sem notuð er fyrir birgðasvæði fyrir gáma. Skipulags- og byggingarfulltrúi gerði 10.06.2009 lóðarhafa skylt að fjarlægja gámana innan tveggja vikna. Yrði ekki brugðist við því mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta skv. 57. grein skipulags- og byggingarlaga nr. 37/1997. Skipulags- og byggingarfulltrúi vísaði málinu 01.07.2009 til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð gerir eigendum gámanna skylt að fjarlægja þá innan tveggja vikna.   • 0906048 – Skipalón 23, site finishing

    Borist hefur tölvupóstur frá íbúum að Skipalóni 25 dags. 26.05.2009, þar sem kvartað er undan umgengni á byggingarlóð Skipalóns 23. Skipulags- og byggingarfulltrúi gerði 10.06.2009 byggingaraðila skylt að ganga þannig frá á byggingarstað að ekki stafi hætta af né sé til óþæginda fyrir nágranna. Yrði ekki úr þessu bætt innan tveggja vikna mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta skv. 57. grein skipulags- og byggingarlaga nr. 37/1997.     The Planning and Building Committee shall require the builder to ensure the construction site is managed in such a way as to pose no danger or cause no inconvenience to neighbours. If this is not rectified within two weeks, the Planning and Building Committee will make a proposal to the Town Council for the imposition of a fine in accordance with section 57 of the Planning and Building Act No. 37/1997.;

  • 0811062 – Hólabraut 15, unauthorised development

    Tekið fyrir að nýju bréf Húseigendafélagsins dags. 04.11.08 varðandi óleyfisframkvæmdir Jóns Karls Grétarssonar á 1. hæð hússins. Ekki hefur verið brugðist við ítrekuðum athugasemdum skipulags- og byggingarfulltrúa, sem ákvað á fundi 11.12.2008 að yrði ekki brugðist við athugasemdum innan eins mánaðar eða breytingarnar fjarlægðar myndi hann leggja til við skipulags- og byggingarráð að beitt verði dagsektum skv. VI. kafla skipulags- og byggingarlaga. Skipulags- og byggingarfulltrúi vísaði erindinu 01.07.2009til skipulags- og byggingarráðs með eftirfarandi tillögu:%0D“Skipulags- og byggingarráð ítrekar að eigendur sæki um leyfi fyrir umræddum framkvæmdum, sem fjallað verður um samkvæmt skipulags- og byggingarlögum. Berist ekki slík umsókn innan fjögurra vikna eða breytingarnar verði fjarlægðar að öðrum kosti, mun skipulags- og byggingarráð leggja til við bæjarstjórn að beitt verði dagsektum skv.     The Planning and Building Committee reiterates that the owners must apply for permission for the said works, which will be dealt with in accordance with the Planning and Building Act. If such an application is not received within four weeks, or the alterations are not otherwise removed, the Planning and Building Committee will recommend to the Town Council that a daily fine be imposed in accordance with Chapter VI of the Planning and Building Act.

  • 0903168 – Reykjavíkurvegur 50, Krónan, site maintenance

    Tekið fyrir að nýju bréf frá húsfélaginu Reykjavíkurvegi 50, þar sem borin er fram kvörtun vegna gáma verslunarinnar Krínunnar, sem eru mjög til lýti og óþæginda fyrir íbúa hússins. Skipulags- og byggingarfulltrúi gerði 10.06.2009 eigendum gámanna skylt að ganga þannig frá þeim að ekki sé til lýti og óþæginda fyrir nágranna. Yrði ekki úr þessu bætt innan tveggja vikna mundi skipulags- og byggingarfulltrúi gera tillögu til skipulags- og byggingarráðs um beitingu dagsekta skv. 57. grein skipulags- og byggingarlaga nr. 37/1997.     The Planning and Building Committee requires the owners of the containers to ensure they are arranged in such a way as not to cause an eyesore or inconvenience to neighbours. If this is not rectified within two weeks, the Planning and Building Committee will make a recommendation to the Town Council for the imposition of a fine in accordance with Article 57 of the Planning and Building Act No. 37/1997.;

  • 0901130 – 50 Reykjavíkurvegur, shop alteration

    Smáragarður ehf applies on 14 January 2008 for a change to a shop. New entrance on the west side, emergency exit on the east side, and alterations to the shop interior in accordance with drawings by Jóhann Sigurðsson dated 08.01.2009, together with stamps from the Health Authority and the Capital Region's Fire and Rescue Service. The Planning and Building Officer approved the application on 14 January 2009, on receipt of a corrected registration table. As the registration table has not been received, the building permit has not come into effect. On 11 March 2009, the Planning and Building Officer required the owner to submit a corrected registration form within two weeks. If it was not received within the specified time, the matter would be referred to the Planning and Building Committee with a recommendation for action. On 07.04.2009, the Planning and Building Committee required the property owner to submit a corrected registration table within two weeks. Failure to comply would result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed, in accordance with Section 57 of the Planning and Building Act No. 73/1997.

    The Planning and Building Committee makes the following recommendation to the Town Council:
    “The Hafnarfjörður Town Council approves the imposition of daily fines on the owner from 1 August 2009, in accordance with section 57 of the Planning and Building Act No. 73/1997, if the requested documents have not been received by that date.“

  • SB050418 – Klukkuberg 32

    A complaint has been received from neighbours regarding poor site tidiness and a risk of accidents from the construction work. On 22/04/2009, the Planning and Building Officer required the owner and the building supervisor to rectify this within two weeks. If this was not rectified within the specified deadline, the Planning and Building Officer would make a recommendation to the Planning and Building Committee for a fine in accordance with section 57 of the Planning and Building Act. „On 26.05.2009, the Planning and Building Committee required the owner and the building supervisor to rectify the site's condition within two weeks. If this is not rectified within the specified deadline, the Planning and Building Committee will make a proposal to the Town Council for a fine in accordance with section 57 of the Planning and Building Act. No action has been taken.

    The Planning and Building Committee makes the following recommendation to the Town Council:The Hafnarfjörður Town Council resolves that daily fines shall be imposed on the owner and the building supervisor from 1 August 2009, in accordance with section 57 of the Planning and Building Act No. 73/1997, if the condition of the site is not rectified by that date.

  • 0903275 – Dalshraun 15, registered tenancy agreement and registration of home address

    Mjölnir Gunnarsson is applying for housing benefit and to register his home address at Dalshrauni 15. A registered lease agreement for residential accommodation in the property was presented. On 1 April 2009, the planning and building officer pointed out that there is no approved flat in the building, which is zoned for business use. The flat would therefore be illegal and must be vacated without delay. If this was not done within two weeks, the planning and building officer would make a proposal to the planning and building committee for the imposition of a fine in accordance with Chapter VI of the Planning and Building Act No. 73/1997. On 28 April 2009, the Planning and Building Board ordered the owner to vacate the illegal dwellings in the building with immediate effect. If this was not done within two weeks, the Planning and Building Board would make a proposal to the Town Council for daily fines, citing Article 57 of the Planning and Building Act. The request has not been responded to.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves the imposition of daily fines on the owner from 1 August 2009, in accordance with section 57 of the Planning and Building Act No. 73/1997, if occupation is not completed by that date.“;

  • 0812107 – 18-20 Vesturgata, works

    Geir Garðarsson of Vesturbraut 4 makes an objection regarding the works at 18-20 Vesturgata, where the roads are in a poor state, fences that were erected have collapsed in places, and the difference in level between the plots is significant. On 11.03.2009, the Planning and Building Officer required the developer of 18-20 Vesturgata to provide a plan and timetable for the completion of the site at 4a Vesturgata within two weeks. This has not been addressed. On 15 April 2009, the planning and building officer reiterated the instruction regarding a plan and timetable for the site's completion. If this was not complied with within two weeks, the planning and building officer would make a recommendation to the planning and building committee to impose daily fines in accordance with Section 57 of the Planning and Building Act. The Planning and Building Committee adopted the building officer's instructions on 09.06.2009. If this was not addressed within two weeks, the Planning and Building Committee would make a recommendation to the Town Council to impose daily fines in accordance with Section 57 of the Planning and Building Act. The request has not been addressed.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves the imposition of daily fines on the owner from 1 August 2009, in accordance with section 57 of the Planning and Building Act No. 73/1997, if the requested information has not been received by that date.“
