    • SB040377 – Minutes of the Planning and Building Officer

      Minutes from the planning and building officer's disposal meetings of 18.11.2009 and 25.11.2009 were presented.

      Part A of the minutes is submitted to the town council for approval.;

    • 0810265 – Regional Plan for the Capital Region 2001-2024, The Green Triangle, revised definition.

      The email of 25.08.2009 from Harald Sigurðsson, Project Manager at the Planning and Building Department of the City of Reykjavík, together with its attachments, concerning comments on the regional planning amendment regarding the Green Ribbon, is reconsidered. It is proposed that the City of Hafnarfjörður approves the change. A letter from Haraldur Sigurðsson dated 21 November 2009 is presented, which states that the approval of the city council is required for the matter. The director of the department left the meeting during the handling of the matter.

      The Planning and Building Committee makes the following recommendation to the town council:“The Hafnarfjörður Town Council approves the proposal for an amendment to the Regional Plan for the Capital Area 2001–2024, regarding the Green Corridor, dated 16.02.2009.";

      The minutes of the Environment Committee/Local Agenda 21 meeting of 30 November 2009 were presented.

    • 0911556 – Krýsuvík detailed plan for research boreholes

      A proposal by VSÓ Consulting on behalf of HS-Orka for a detailed plan for a site for exploration boreholes in Krýsuvík, dated 24 November 2009, was submitted, together with a proposal for an environmental assessment statement.

      The Planning and Building Committee agrees that the outline planning application will be advertised in accordance with section 26(1) of the Planning and Building Act No. 73/1997. The Planning and Building Committee makes the following recommendation to the Town Council:

      “The Town Council of Hafnarfjörður approves that the proposal for a detailed plan for a site for research boreholes in Krýsuvík, dated 24.11.2009, together with a proposal for a statement of significance, shall be advertised in accordance with the first paragraph of Article 26 of the Planning and Building Act No. 73/1997.“;

    • 0903036 – Master Plan of Hafnarfjörður, amendment Sléttuhlíð

      The proposal from the Planning and Building Department dated 04.03.2009 for an amendment to the Hafnarfjörður 2005–2025 Master Plan, concerning an increase in the Sléttuhlíð settlement area, is reconsidered. Text amendment. The planning proposal was advertised on 24 August 2009 in accordance with Article 18 of the Planning and Building Act No. 73/1997, and the consultation period closed on 9 October 2009. Comments were received. A revised summary from the Planning and Building Department, dated 20.11.2009, of the comments received, and a proposal for responses to them, was presented.

      The Planning and Building Committee endorses the report of the Planning and Building Department. The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves an amendment to the Hafnarfjörður Master Plan 2005–2025 concerning an increase in the Sléttuhlíð settlement area, dated. 04.03.2009 and that the matter be concluded in accordance with Article 18 of the Planning and Building Act no. 73/1997.“;

    • 0905031 – Gunnarssund 9, zoning plan amendment

      The proposal from Ark ehf for a change to the detailed plan for the city centre site, according to the drawing by Jon Nordsteien dated 06.05.2009, is reconsidered. The application has been subject to local consultation in accordance with section 2 of Article 26 of the Planning and Building Act no. 73/1997. Objections were received. The detailed plan was approved by the Planning and Building Committee on 07.07.2009, but was annulled by the Planning and Building Appeals Board due to a procedural defect in its public consultation. The Planning and Building Board approved on 20 October 2009 to advertise the proposal in accordance with the first paragraph of Article 26 of the Planning and Building Act. The period for public consultation is from 22 October 2009 to 20 November 2009, and the deadline for comments is 7 December 2009. The Director reports on an information meeting regarding the draft detailed plan held on 23 November 2009.

    • 0812152 – Selvogsgata 1, building permit

      A letter from Bjögvin Þórðarson of the Lex law firm, on behalf of the residents of Brekkugata 26, was presented. 24.11.2009, where an objection is raised to the works at Selvogsgata 1, where concrete is being poured for windows in the basement flat of Brekkugata 1. Objection is also raised to the documents that accompanied the local consultation.

      It has been revealed that the drawings submitted for the local consultation for the extension to 1 Selvogsgata are questionable in their compliance with the provisions of section. 18.3 of the Building Regulations No. 441/1998, as amended. It is therefore uncertain whether the information sent out has met the requirements for design documents, in such a way that neighbours could appreciate the impact of the changes on their property. The Planning and Building Board instructs the Department of Planning and Building to seek an opinion from the Planning Authority on this matter, in accordance with Article 4 of the Planning and Building Act No. 73/1997, as amended, and to request urgent processing of the case. The Planning and Building Board requires the owner of Selvogsgata 1 to temporarily halt the works on the wall at Brekkugata 26 until the opinion of the Planning Agency is available. The project owner may submit comments to the Planning and Building Authority and/or the Department of Planning and Building regarding this decision.;

    • 0712080 – Town Centre - Hraun, detailed plan

      Re-examination of the detailed plan for the area bounded by Flatahraun, Álfaskeið, Arnarhraun and Reykjavikurvegur. Previously, a plan by Arkitektur.is dated 07.05.01 and draft planning regulations dated 03.05.01 were submitted. The Planning and Building Committee instructed the Planning and Building Department on 18.12.2007 to proceed with the detailed plan. A revised drawing and planning conditions from Arkitektur.is, dated 15 October 2009, were presented. Páll Tómasson of Arkitektur.is attends the meeting and gives a presentation.

      The Department of Operations presents the working group's findings to the Planning and Building Committee, and also requests the Committee's opinion.

    • 0702005 – Master Plan of Hafnarfjörður, power lines and substations.

      A letter from the Planning Authority, dated 18 November 2009, regarding the advertisement of an amendment to the 2005–2025 Master Plan for Hafnarfjörður concerning the Southwest Lines in Hafnarfjörður was presented.

      Submitted. The Planning and Building Committee instructs the Planning and Building Department to compile comments and responses to the letter from the Planning Authority and to seek the opinion of the parties referred to by the Planning Authority.

    The Director of Operations reports on discussions with representatives of Alcan – Rio Tinto on 16 November 2009.

    The Planning and Building Committee instructs the Head of Department to report on the discussions at the next meeting of the Town Council.;

  • 0906057 – Nature Conservation Plan 2009-2013, motion for a parliamentary resolution

    The Parliamentary Environment Committee is sending for consultation a motion for a parliamentary resolution on the 2009-2013 nature conservation plan. The proposal was sent for consultation during the 136th and 137th legislative sessions, and consultees are given the opportunity to submit a new consultation by 30 November 2009 or to have a previous consultation stand.

    Trausti Baldursson left the meeting during the handling of the matter.The Planning and Building Committee decides to uphold the previous opinion of 19 June 2009.;

  • 0911585 – Regional Plan for the Capital Region 2001-2024, Mosfellsbær

    A letter from Harald Sverrisson, Mayor, dated 24.11.2009, together with a proposal for a minor amendment to the Regional Plan for the Capital Area 2001–2024, an extension of the industrial area at Tungumelamir. Comments are requested by 24.12.2009.

    The Planning and Building Council instructs the Department of Planning and Building to prepare a draft report on the proposal.;

  • 0901233 – Grindavík Master Plan 2000-2020, Vatnskarðs Quarries and Suðurstrandar Road

    A letter was presented from Ingvar Þór Gunnlaugsson, Head of the Technical Department of Grindavík, requesting an opinion on a proposal for an amendment to the Grindavík 2000–2020 Master Plan regarding the altered alignment of the Suðurstrandarvegur, along with an environmental report. The proposal is being advertised and the public consultation period closes on 30 December 2009.

    The Planning and Building Council instructs the Planning and Building Department to prepare a draft report on the proposal.;

  • 0911591 – Budget 2010, Planning and Building Department

    The Director presents the draft 2010 financial plan and long-term plan for 2010–2012, the plan for organisational work for 2010–2012, and the status of projects for 2009.

  • 0903127 – The town boundary between Hafnarfjörður and Garðabær at Hrafnista

    The Director previously reported on discussions with the Planning Manager of Garðabær regarding a change to the municipal boundaries between Hafnarfjörður and Garðabær, due to the new Hrafnista building and other minor changes. Previously, a drawing from the Planning and Building Department was presented, showing a potential change at Hrafnista. A letter from Arinbjörn Vilhjálmsson, Town Planner for Garðabær, dated 26.11.2009, was presented regarding the Garðabær Town Council's decision on the matter.

  • 0901130 – 50 Reykjavíkurvegur, shop alteration

    Daily penalties had been imposed, as the building permit was approved on the condition that the corrected documents (the register table) were submitted. Those documents have now been received, and the daily penalty case is therefore considered closed.

  • 0905152 – Hvaleyrarbraut 35, illegal occupation.

    Information has been received about illegal occupation of the house. It has also been reported that the house is still registered at construction stage 1 and that the required inspections have not been carried out, including the certificate of occupancy inspection. On 20 May 2009, the planning and building officer required the owners to provide information on the matter within two weeks. No response was received. On 10 June 2009, the Planning and Building Officer referred the matter to the Planning and Building Committee. On 23 June 2009, the Planning and Building Committee required the owners to provide information on the matter within two weeks. If these were not received within that time, the Planning and Building Committee would make a proposal to the Town Council to impose a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997 until the matter is rectified. The Planning and Building Committee agreed to grant an extension until September. No further clarification was received after that time. Reported from a meeting of the Planning and Building Department with Ivar Erlendsson, a representative of the property's owners, who denied that the property was occupied but prevented an inspector from entering to verify this. On 20/10/2009, the Planning and Building Committee demanded that a building supervisor be appointed for the property within two weeks and immediately call for a site inspection. The Planning and Building Committee also demanded that the inspector from the Planning and Building Department be granted immediate access to verify whether the house is occupied. Should neither be addressed within two weeks, the Planning and Building Committee would make a recommendation to the Town Council to impose daily fines in accordance with Section 57 of the Planning and Building Act No. 73/1997. The request has not been addressed.

    The Planning and Building Committee makes the following recommendation to the Town Council:“The Hafnarfjörður Town Council approves the imposition of a daily fine of kr. 50,000 on the property owner, from 1 January 2010, should the request to appoint a building supervisor to the project and submit as-built drawings of the house not be complied with, apply for the required inspections and grant an inspector from the planning and building authority access to the property to verify whether it is occupied.“;

  • 0910988 – Burknavellir 1 A,B,C, final inspection

    The letter from the residents„ association of Burknavöllar 1 A, B and C, dated 03.10.2009, requesting that the planning and building officer make it mandatory for the building supervisor, on 07.10.2009, to apply for a final inspection of the building within four weeks in accordance with section 53.1 of the building regulations. Should this not be complied with, the Planning and Building Officer will refer the matter to the Planning and Building Committee with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997. The matter was considered at a service meeting of the Planning and Building Officer on 18 November 2009, who referred it to the Planning and Building Committee with the following recommendation: “The Planning and Building Committee directs the building supervisor of the house to apply for a final inspection of the house within four weeks, in accordance with section 53.1 of the Building Regulations. Failure to comply with this will result in the Planning and Building Committee referring the matter to the Town Council with a proposal for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997."

    The Planning and Building Committee directs the building's builder to apply for a final inspection of the building within four weeks, in accordance with section 53.1 of the Building Regulations. Failure to comply with this will result in the Planning and Building Committee referring the matter to the Town Council with a recommendation for a daily fine in accordance with section 57 of the Planning and Building Act No. 73/1997.;

  • 0908111 – Furuvellir 3 and 5, plot boundaries

    Björg Gunnarsdóttir of Furuvellir 5 makes an objection in a letter dated 15.08.2009 regarding an open storage facility on the plot boundary, which has been erected without a permit. The Planning and Building Officer previously objected to a shed that was erected without a permit on the plot outside the building envelope. A reminder was sent on 12 November 2009. On 19 August 2009, the Planning and Building Officer required the owner of Furuvellir 3 to remove the illegal structures, which are in breach of Articles 11 and 67 of the Building Regulations. Failure to comply within two weeks would lead the Planning and Building Officer to recommend to the Planning and Building Committee the imposition of a fine in accordance with Article 57 of the Planning and Building Act No. 73/1997. The matter was considered at the processing meeting of the Planning and Building Officer on 18 November 2009, which referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee directs the owner of Furuvallar 3 to remove the illegal structures, which are in breach of Articles 11 and 67 of the Building Regulations. If this is not complied with within two weeks, the Planning and Building Committee will make a proposal to the Town Council for the imposition of a fine in accordance with section 57 of the Town Planning and Building Act No. 73/1997.“

    The Planning and Building Committee requires the owner of Furuvallar 3 to remove the illegal structures, which are in breach of Articles 11 and 67 of the Building Regulations. Failure to comply within two weeks will result in the Planning and Building Committee recommending to the Town Council the imposition of a fine in accordance with Section 57 of the Planning and Building Act No. 73/1997.;

  • 0804310 – Miðvangur 41, flat 205, alterations

    Comments have been received from the board of the residents' association, Miðvangur 41, dated 22.04.2008, stating that illegal works are underway in flat 205. An on-site inspection has revealed that alterations are being carried out without the required permit. On 14.05.2008, the flat owner was ordered to immediately cease the works in accordance with section 56 of the Planning and Building Act. According to information received, an opening has been created between the living room and the balcony, and the flat is being renovated. On 06.05.2009, the planning and building officer requested drawings showing the aforementioned works, in particular whether the building's load-bearing structure had been altered. No response was received. On 11 August 2009, the Planning and Building Committee required the flat owner to submit drawings of the alterations within 4 weeks. Failure to comply would result in the Planning and Building Committee recommending to the Town Council that a daily fine be imposed in accordance with section 57 of the Planning and Building Act No. 73/1997.

    The Planning and Building Committee makes the following recommendation to the town council:“The Hafnarfjörður Town Council approves that a daily fine of kr. 30,000 shall be imposed on the property owner, from 1 January 2009, if the request is not addressed by that date.“;

  • 0910333 – Arnahraun 21, flat 0101, illegal occupation

    It has come to light that an unauthorised dwelling has been created in a storage room within the communal area of Arnarhraun 21, which also fails to comply with the provisions of the building regulations. On 07.10.2009, the Planning and Building Officer required the owner of the storage room to vacate the premises within four weeks and to remove all alterations carried out without a building permit. Failure to comply within this timeframe would result in the Planning and Building Officer referring the matter to the Planning and Building Committee with a recommendation for a fine in accordance with section 57 of the Planning and Building Act no. 73/1997. The matter was considered at a service meeting of the Planning and Building Officer on 18 November 2009, who referred it to the Planning and Building Committee with the following recommendation: „The Planning and Building Committee requires the owner of the storage unit to vacate the premises within four weeks and to remove all alterations carried out without a building permit. Failure to comply within this timeframe will result in the Planning and Building Committee referring the matter to the Town Council with a proposal for a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.“

    The Planning and Building Committee requires the owner of the storage unit to vacate it within four weeks and to remove all alterations carried out without a building permit. Failure to comply within this timeframe will result in the Planning and Building Committee referring the matter to the Town Council with a proposal for a fine in accordance with section 57 of the Planning and Building Act No. 73/1997.;
